Why you think they're violating Sythe rules:
A guy named Euro bought the project files from me so he could edit the text on the banner. It seems like he has shared these files with @Menk, who has been using my project files to make banners for several clients for money. It is one thing to plagiarise, but to use someone else's project files and change nothing but the font is a disgrace.

Why is this problematic?
1) I have not given Menk permission to use my files.
2) He has no commercial license.
3) He has made money by using my assets.
4) One of the banners he made using my files is on the bottom of Sythe.

What should happen?
1) @Menk should pay me all the income he's generated using my files.
2) The bottom banner on Sythe should be removed. @Menk should provide ER with a new banner to use as an advertisement or pay for their advertisement slot.
3) @Menk should receive a ban from the Graphic Marketplace for serious misconduct.

This is not acceptable behavior and you should not be allowed to call yourself a graphic artist nor run a graphic shop you incompetent slug.

Only god knows how many copies he has mass produced and sold. If you're gonna rip my work, at least change the color scheme or something. You could have used my files to learn from but instead you saw an opportunity to, not only f*ck me over, but also your clients.

I offered him the project files for 50% of the project cost so he could edit the text on the banner when he needs.

The reason I offer the files is so that the buyer can edit his unique design without having to pay me for post-order modifications. When you buy project files on any other site there is two types of licenses, a regular license and commercial license which often costs more than double. A commercial license would allow him to use my asset to produce unique banners and sell them. Here is the thing though. He bought the files for personal use which can be seen from chat logs.

@Menk definitely did not have permission to use them no permission to mass produce identical banners.

I would say that taking advantage of the situation and pump out as many identical copies as possible is a serious offense. Especially considering the customers were unaware that they got f*cked over until I informed them. He even gave them half price because of the greed. Probably wanted to make as much money as possible before getting caught.

First of all @Izad I won't be insulting you with words that you pointed out to me such as moron, smart-ass and so on to you I hope you will take these back and apologies for that.

@BlackBlasses I have bought back when I was running my gambling clan banner and files from @Izad approximiertly $450 and all his work was done within 30-60 minutes and the original price without files was around $225. So he charged me 50% more because of files and in his ToS there was NOTHING STATED about changing these things in his files. I won't go on and comment and defend myself on things such as that I am greedy moron and so on because that's pointless. If I wanted to be greedy I would charge insane amounts for my art work same as he does my hourly rate is $10-20 which is nowhere near greedy imo compared to his hourly rate but as I said it's pointless to argue about that I have paid the files fairly and the payment was huge + huge fees back then for btc. I could go on and type a whole book about defending myself regarding these accusation that I cloned every single banner that I have done, maybe only 4 out of 20 are identical to one that he has done for me once which I have files of and have paid fairly for those.

@Izad again I hope you will apologies for bad words your comments are really rude after charging insane amount for just 1-2 files...

First I just need to respond to all irrelevant shit you spewed out:
What? You won't insult me? 10 points to f*cking Gryffindor. Mathematics: 225 * 1.5 ≠ 450. And the banner I made was $65. Of course your hourly rate is much less. It is supposed to be much less. Compare the quality of our work.

Now, you paid for the files so you could change the text when you need. Were you in acute need of income so you had to mass-sell my design? Or am I missing something here? Even if you buy project files from e.g. VideoHive you can pay for either a regular or commercial license. The regular license allows you to download the files and use in an end product which you are not allowed to sell. The commercial license allows you to make an end product that you may sell under the following circumstances:

... meaning that you must still tweak the end product enough to make it unique.

Man, I should not even have to explain this to you. You approach me with a different name, ask me for the files so you can edit the text on your banner and then all of a sudden you've pumped out a ton of duplicates for money. Do you think that is ethical? Within the graphic field it is serious misconduct. And the fact that you display my design as one of your own on your shop and discord server triggers my acid reflux.


SHIT, I forgot one detail. In this screenshot you claim that you don't have a Sythe account. Does that mean we treat Menk and Euro as two individual juridical persons? Because if so, you still haven't paid me sht for the files.

 

It's pointless to argue with you man you will dig now into every single message to try and take things out of context to cover up your false report. Last picture I said I don't have sythe account because I don't with name Euro (that brand name). I will leave this up to mods to decide whether your claims are valid or not. Imo I have paid fairly for the files and have the rights to use it. My advice to you update your ToS and make it clear that you don't allow any changes on your files to be shared, sold or anything like that. Again mods can check my thread and see that most of my banners and arts have been done from scratch by myself and are not identical at all with the one you gave me but as I said I have fairly paid you everything for the files obviously I will use them who is crazy enough to pay double the price for files and not be allowed to change anything on those files?

 

Exactly, you are allowed to change the text. This privilege is exactly what you paid for.

To mods: nothing is taken out of context. I will export and provide you my entire chat history with Euro including the part where he tried to convince me to read the Quran and convert to Islam.

Please stop confusing moderators, I have been paid by Dragon Dyce owner to put that banner on my sythe threads (sponsored advertisement), but i didn't know that i have to write above banner it's sponsored, since all admins/mods that rent their signature spots never write that advertisement is sponsored.

You did not make the banner you are displaying on your thread. I made it.
You have not added any text effects, video effects nor transitions yourself.
You have not even changed the color theme nor the font.

You specifically asked for the project files to edit the text on it when you need to and I gave you a price based on that. If you would have asked me for the project files so you could replace the logo and re-sell it for a profit you would have gotten another price. And guess what that price would have been? NOT FOR SALE. Because that is not how I - or any other artist with integrity on Sythe - work.

Go make a club with Johnson.

 

3 copies have been sold with help of that file that I have bought from izad. (I have been paid 240M 07 for these 3 copies)

I don't mind compensating with Izad also I understand his frustration but I have also paid for those files which makes it pretty much even I didn't make any profit from these 3 banners overall when we put the money that I have paid for files into the case.

 

I understand that the customers which Menk sold the copies to are directly affected by his offense. To make it less difficult, I will allow them to keep and use the banners under the circumstance that @Menk pays me all the income generated and takes the punishment that plagiarism warrants. He should, of course, also remove the banner from his shop and server to prevent any confusion or misleading customers.

As a little last note: you paid exactly $32.5 for the files. The rate of 07 is approximately $0.4/m and you got paid 240m total, which means you almost tripled the investment. It is time to stop bullshitting.

 

In my opinion you are asking for too much now I am trying to be nice but your ego won't let you be reasonable I will leave it up to mods to decide a bit more fairly considering this was your fault for not having clear ToS regarding files editing.

 

You are not a victim here. I am nothing but fair. Learn to take responsibility for your actions.

 

Nope that would be valid argument if your ToS was matching your claims and clearly it's not.
