That's BS. Every school has much more specific dress codes, no matter what. I'm not entirely sure about which states, but I am quite sure that every state has laws that require that you agree to those terms to enroll.

Public schools can't unreasonably restrict free speech just because they don't like the message (unless it's counter productive to the school's mission: education).

wtf that kid is lucky he is in the 21st century. 100 years ago he would get his ass raped with a ruler if he threatened to sue the school. he should be thankful they didn't just kick his ass out of school but let him stay with his shirt turned inside out. pathetic.

I just pulled this out from the school district I went to last year -

    http://sd54.org/SD54/Guidelines/JFCAR.pdf

B 1 and 2, and C clearly describe dress code. It's just an example, but I'm positive just about every school has guidelines similar to these.

So it depends on whether the court views his shirt as
(assuming that his dress code is similar to yours)

Not everyone has those kind of dress codes. My school use to not really have a dress code as well other than nothing pertaining to drugs, gangs, or guns.

This reminds of something I saw on the news where two girls got suspended I think or just got in trouble for taking handbags with the confederate flag lol.

It does violate the constitution. Freedom of speech and expression is limited if it threatens, violates, or causes substantial harm the rights of one group or person.

Also, when you're in a school building, you must abide by the laws set by the school itself, which usually voids fourth amendment rights, and many others.

update: Tell your cocky friend he's a dumbass, thinking about suing the school because the administration asked him to flip his shirt. I have a friend that literally left his backpack in an office, and they searched it and found a machete, then suspended him for a week. That would be a better reason to file a lawsuit, but being asked to flip his shirt is ridiculous.

beyond the schools policy's, thats shirt could be easily found racist. We have freedom of speech but not the freedom to insult people

Well I think the kid will loose. One time in my school a teen sued the school when his leg broke during a football game and are school became poor now we don't have a football team.
