Ok, let's begin; I'll assume that Lean owns the domain rsgpbank.com

Ownership of the domain presumably entitles Lean to two things:

1. To exclude others from using the domain; and
2. To use the domain.

Those are the rights you have. To my understanding, rsgpbank is not actually infringing on those rights. What rsgpbank is doing is associating the domain rsgpbank.com with his Sythe.org account (he does that in the posts you quoted). He is not actually using the domain.

What you may have intellectual property rights to is rsgpbank as a trademark. Trademarks are used to distinguish between the source of a good/service. Trademarks can be registered or unregistered. In this case, the phrase rsgpbank is being used to distinguish between the source of the RSGP Gold. The trademark however is presumably unregistered. If you can show me that you have registered the trademark in a country in the world I will be surprised.

Unregistered trademarks, can be protected under the tort of passing off. You basically need to show 3 things in order to show that @rsgpbank , by using the phrase 'rsgpbank.com' has 'passed off' his goods as yours. If you can, you would would be entitled to compensation. I very much doubt you can show those three things; here they are:

1. You need to show that you own some goodwill with respect to the phrase 'rsgpbank' in the RSGP sale business. Some reputation. [This is not made out - you need to demonstrate this empirically]; and
2. You need to show that there has been misrepresentation [This is 100% made out]; and
3. You need to show the @rsgpbank 's misrepresentation has actually damaged your goodwill/reputation [This is not made out].

I don't think you've made out 1 and 3, and so your rights have not been infringed, and so you are not owed any damages. You are welcome the demonstrate that (a) you do actually own some goodwill/reputation in the phrase 'rsgpbank' in the RSGP sale business; and (b) that @rsgpbank 's actions actually damaged that goodwill/reputation.


That being said, there clearly is misrepresentation IF you own the domain rsgpbank.com and IF @rsgpbank is telling everyone that he is the owner of that domain when he clearly isn't. Sythe.org doesn't allow that type of misrepresentation. Accordingly, @rsgpbank you need to give evidence that you own the domain, or have a right to use that domain name. If you can have the domain link to your Sythe.org Vouch thread, I will accept that as evidence, otherwise, in the absence of evidence, you are NOT allowed to use the phrase 'rsgpbank.com' anywhere, and doing so will warrant infractions, and potentially a ban.

EDIT: O and Lean, you also have to demonstrate that you own the domain name (my analysis above is just based on the assumption that you do).

Your claims of copyright infringement are dismissed: you own no copyright. Your claims of plagiarism are dismissed.
