If you can prove that you were the rightful owner of the CD, you should be protected by US Copyright Laws. Just tell the truth (if this is it). If you've bought the CD (and have proof that you bought it before this whole torrent thing) then you'll be fine. Since if you had a CD your allowed to burn it as many times for your own personal use, downloading it is like the same concept.
That sucks how you got caught though, getting caught must be rare though. I torrented shitloads and never got caught for anything.

Explain yourself, properly, no emotion or any of that bullshit, make it seem like you were doing the logical and proper thing to do, that anyone else would do, then once they let you off, tell them to go fuck themselves. Where did you buy the disc from anyway?
You might also be able to show them that the disc doesn't actually work, to prove that that's why you did download the torrent.

I do it with teachers all the time when I forget to turn soemthing in, but "No excuses!" teachers are different than a corporate lawyer/judge.
I don't know if you can't get caught. A torrent is a separate issue. Illegal downloading is illegal. If you're caught, just suck it up and pay the consequences as long as you can't argue out of it.

IDK, Chrater caught me downloading Photoshop CS3. I just told them I had a virus or something lol. Since I switched to AT&T I haven't been busted. Maybe it's because I've been a bit smarter, but still..
