Counter Lawsuit for botters?

Just wondering if anyone has come up with ways that sound good as a counter lawsuit for Jagex.

So far I've seen privacy infringement, as well as Harassment.

Anyone else have any other ideas?

(to clear this up)

The idea is not to sue Jagex for no reason, or simply because of the game. Its simply a counter-suit against them because the e-mail addresses obtained are believed to be obtained unlawfully. Also, threats of a lawsuit in countries where the DMCA doesn't apply could be considered harassment. Please contribute with either ideas or criticism, not baseless posts about nothing.

PS: I did see another thread about this that got locked because the post made literally no sense. Hopefully this one is okay.

I'd like to credit MrInfinity for the idea of this thread, and allowing me to use it.

EDIT: A good majority of you are failing to understand the reason for the creation of this thread. I'm not trying to sue anyone because I botted on Runescape. That isn't and was never the question I was asking. It is believed that the e-mail addresses that these "threats" were sent to were obtained illegally by Jagex. Now I honestly believe this letter to be a bluff, but it troubles me that they someone found a way to get my contact information from paypal, when I've never once linked anything to that e-mail address besides PayPal.

Hey now, I offered harassment as my main idea. The question marks were simply because I wasn't sure on how to go about it.

I was talking to some kids from Australia and they said they could possibly sue because it's illegal there to make idle threats like that, because DMCA does not apply there.

I didn't look into it but just passing along some here say.

If you'd like I'll credit you in the OP for the idea.

I'm sure there are several legal actions that can be taken against Jagex, just aren't 100% sure on what each could be.

Lol I'll settle for a chunk of the change we take away from Jagex, but I'm sure in countries where the copy right doesn't apply it could be harassment.

I've been manipulating it in my mind, trying to see if I could get black mail out of it but I don't see it.

Also according to Dropin' Pl8's (http://sythe.org/showthread.php?t=1264063) nexus gave up the information unassumingly without a subpoena (that's the impression he gave me) depending on their terms of agreement (if you could track it down) they may have broken that and you could possibly sue Nexus. No clue just some guesses, I am by no means a lawyer. :p

You will have to pay out big for a good lawyer because this would be a higher profile case than just a normal court case because it is going to be followed closely by the botting communities. IMO, not worth it unless you go for class action for all botters in certain countries.

that's a part of their privacy agreement. they can decide what to use the information themselves. Problem solved and no lawsuit possible.

Lol, get a panel of scientists to prove that botting actually benefits childrens education, social life, and general health because they don't spend hours a day in front of a computer, grinding away mindlessly like a zombie.

... This would never happen in a million years but that would be pretty awesome  I could see the Judge swinging his gavel in favour of the botters if this was the case.

The fact that they are obtaining e-mails that weren't added to accounts on Runescapes website HAS to be privacy infringement. If they were acquired through paypal then legal action should be able to be taken against paypal, no?

EDIT: So are you saying that it is impossible for the to file a suit against its customers? I didn't see anything saying that any action can be taken against their products consumers if the rules of the game were broken using said information they gathered "lawfully".

They weren't taken from paypal, they were taken from nexus, or dropin' pla8's has given that as the real culprits because there in no subpoena. If you read their ToS they say nothing about not giving out your email, they will use your information as they see fit.

You can't counter sue for harassment... They're giving you a notice to seize what you're doing or you can possible face legal action. That ain't harassment.

In some countries were no legal action could ever be taken, yes it is considered harassment because there is no legal issue and it's an idle threat.

discrimination? because mainly us botters received the email

This a troll thread? Or just stupidity? Basically, in doing this you are telling the courts and Jagex you are guilty and you are more liable to pay court costs.

horrible idea. if botting was allowed it would ruin the game. im all for botting, but botting on the scale that it was happening is ridiculous. i use bots because i dont have the time to train. im for that. im against botting accounts just to sell them, and goldfarming.

you can't sue them for anything just as they can't sue you unless you have tampered with their copyrighted material (made your own bots/ clients)

How is this more likely to get us in trouble? We are legit players looking to sue a company that is wrongly accusing us. Rethink your idea of stupidity because it's more likely your post.

As far as I know most of the emails were sent to US users (what I've gotten from most of the threads on other forums and sythe).

Nope, I've talked to kids from Australia, England, and Canada that got the email as well. As to how many kids got it in those countries, it is probably lower than americans.

/fail thread

It's their game they can do what ever they want if you dont like it you can just stop playing simple as that...

I'm addressing more than you but some of you fail to grasp the point.

We aren't trying to find a lawsuit because of the game, or because they don't allow botting. It's more along the lines of how they went about mass emailing threatening us with a lawsuit, and how they obtained the emails because a lot of them aren't tied to RS accounts even.

Just because it's owned by them does not mean to say they can do whatever they want with it. If Jagex decided to sell your details provided for your account with 3rd party sites simply because it is 'their game' then this would conflict with law.

Another example could be stores co-ordinating prices. Using your logic, it's their store so they should be able to do whatever they want with it...This is also illegal, what I'm getting at is of course Jagex can do many things, but there are certain thresholds they must abide by.

Lastly, honestly why post unless you have something to contribute? Anyone could post on any thread and say '/fail thread blah blah blah'
