It's fine. They unban people who have actually done things to deserve being banned and let them return as normal users, and in some cases as staff. If anything this approach only pushes the real people away and causes them to want to scam when they would never normally do it.

Excolent or w.e is clearly ban evading and even if he's not his friend is banned who he introduced to Sythe. He is to blame if his name/password/email/IP comes up just like the rest of us. I personally like Excolent, but that doesn't change the fact that rules are rules.
