    Spacegems Poor Trading Practices

    I received a report from one of spacegems' former service workers that spacegems was withholding his deposit and ignoring his messages. I messaged spacegems and received an immediate reply, the worker was also paid quickly afterward. However I believe that spacegems conversation (or entire lackthereof) with the worker rises to the level of poor trading practices and deserves a twc.

    Spacegems replying to me within a minute and claiming he thought the deposit was returned (this user was ignored for 2 weeks, spacegems knew this deposit wasn't returned):

    hey just saw this! Sure can share my side of things :D

    Sn1ky was in fact a worker of mine. He quit somewhat abruptly to work with chicks, and while that didn't make me the happiest camper I still try and follow all the rules. as you can see from the message I sent to him, he had prior to this collected payment for all his unfinished service work and trading, and I was under the impression that he collected his deposit at this time as well.


    Obviously I wont try to cover the fact that his messages didn't get replied to for quite some time, or even read for that matter, we are in pretty much opposite timezones so his messages typically come in with all the messages I get when I sleep and I don't check all of them in the morning as again like the message states I have a ton of things going on.

    Paired with this, he also communicates with my current workers/managers and was paid out for his completed work through one of my managers, so this isn't the only contact he has with me or our server so to speak, meaning to say he wasn't in the dark ,and was infact in contact with us despite what these messages seem to depict.

    He was in fact not paid out his deposit during that time these screenshots show all the way upto today. To explain this, I do have a worker TOS that states that deposits are held 7-14 days after you stop working for us, this was all within this period of time, so regardless of circumstance I feel , since it was paid today which is within the 14 day period I am not really obligated to give any explanation, I never had an intention of stealing it but I was just waiting until I planned on paying it back at the end of the duration to make it a priority.

    This 14 day wait period the case because of two reasons

    1. I buy and sell gold so if deposits are paid back in gold (this one was) then it's best for me to wait until an opportune time when I have lots of gold stock to be able to pay out deposits instead of when I am low on stock and need to hold onto stock to sell.

    2. but MAINLY, this is done for the safety of customers as well as server liability protection in case trading relations or work is still being done between the worker in question and customers in the server in question after their job has been completed. I don't want customers getting scammed because a worker got their deposit back immediately and then was able to scam a customer. SN1ky has continued to interact with our customers with a MOD role in the server which I have only just removed today. While I think he has no bad intentions it's safest to hold the deposit the full 14 days until my TOS states is the latest possible date for me to return it, especially since he is still interaction with the customers in my server in the role of a mod.

    TL;DR

    There were some communication errors on my part however SN1ky communicated with not just me but my workers/managers as well about his deposit, and while it was not ideal that I ignored him personally, he was per my TOS not past the date for his deposit to be overdue to him at any point in this situation and I have paid his deposit in time according to my TOS.

    I can provide my TOS to any staff and you can come to my server to see it was updated last long long ago and sn1ky having been a service manager was well aware of the rules of the worker TOS. This is the second incident I have had with him asking me to repay a ex staff member prior to the 14 day period being up which is unsafe for my server as well as the customers, and just caused conflict between all the staff members as well :(

    without sounding like a douche bag, it seems like the precedent set on this sort of thing is not a TWC even if I HAD gone over the the time required for the deposit to be refunded to the worker, which like I said I did NOT.

    ABRA has had 3-4 recent cases of not paying a worker back a deposit/payment within the required time, not trying to call him out at all but at least 3 of them it looks like were resolved and no punishment was issues despite the fact that it was way over the time to return the deposit.

    So unless there is some portion of those reports that I'm not privy too, there was no punishment's even though it was all the same user who committed offences similar in nature to this report multiple times. I don't' see how once incident, which isn't breaking any rules with regard to my TOS or how I understand TOS/deposits to function in relation to sythe's rules on TOS, could result in a TWC.

    With that said I know the rules regarding TOS can be very specific and I leave any decision completely up to the staff of Sythe as I feel they have the best knowledge of the rules and how they function.

    That user is DNT'd and will need to pardon after they repay all of the people they owe money to. I wouldn't call that no punishment.

    As for this case: you not only ignored the former worker for an extended period of time, but you also cannot provide proof of them agreeing to your terms of service. Which means you didn't even have the right to withhold the deposit in the first place.

    Staff have discussed this and agreed that a TWC for bad trading practices is in order. You may dispute it here in 30 days.
