Precautionary report
About a year and a half ago (May 2018) I purchased a comp cape RS3 account from user online for $800 USD in bitcoin. The trade was successful and all was well until yesterday, when I received a few unexpected password reset emails from Jagex, and then I tried logging in to find that the account had been successfully recovered by someone else. I no longer have access to the account.

Online is is a trusted user here on Sythe (and was back then, too) and I reached out to him today on his new Discord account to see if he is willing to help me out with this.

Note he has since changed Discord accounts from the time of the trade--I can provide Discord screenshots of the original purchase conversation if necessary, but it just says "Deleted User#0000" now, so I doubt it would be valid.

I am submitting a precautionary report in the meantime.

Seller's Sythe profile link: online
Vouches if they were exchanged: My vouch to him | His vouch to me
Original selling thread: user posted in my buying thread here
Proof of contacting seller: https://i.imgur.com/okNIH2c.png | https://i.imgur.com/zpvmsVB.png
Discord ID + Unique Discord ID: currently, on#5500 + 518561211978088451 | previously, online#0101 + 429136688900472832
Any other relevant trade screenshots: My Sythe direct convo with the user at the time (where he states the Discord name he was using back then--different from his current one). Name of the account is redacted. I agreed not to try and get him banned if anything happened, he agreed to do his best to help me out if anything happened. https://i.imgur.com/N4xEElN.png

@Online - can you please fill us in here? Are you still the owner of this account? Has it been resold?
I don't understand how you mean am I still owner? It was traded over so that would be a no as far as I understand.
I do not possess the account, nor have done anytime after trading the account over.
The account was a resell, just awaiting on @Werewolves to send me the username of the account / PM on same thread so I can read it over and see what I can do.

Okay great. Is there a problem here or should I go ahead and close this?

You could leave it open until we reach a satisfactory resolution, if that's okay, unless you think it should be closed (or moved? is there a board on Sythe for non-scammer disputes or is that here?).

Online told me he had information available to recover the account if anything happened and would help me out, so long as I didn't accuse him of being a scammer and try to get him banned--which I'm not, I don't think it was him, now that we know it's a resale (not sure he told me that at the time of the trade, but I guess I have no record to prove it one way or the other so I'm SOL there) I think most likely it was recovered by a previous owner.

If he can't/refuses to help or doesn't have any information, I'd at least request a partial refund, because he definitely promised me that much and I wouldn't have made an $800 trade without that peace of mind.

Sorry, I got confused. Do I have this timeline of events correct?
  1. Someone sold Online an account.
  2. Online sold you that same account.
  3. You didn't resell the account but can't recover it now despite being the rightful owner.
If I have that right, @Online needs to either a) get you the account back, or b) refund you for your purchase (if you're okay with that compensation). Generally, if the seller cannot give the account back to the buyer, he will be banned.

Yes, that is the correct order of events. Online confirmed (here and on Discord) that the account was a resale--meaning, someone sold it to him at some point prior to May 2018, and in May 2018 he sold it to me.

Following May 2018, the account was mine and all was well until just a few days ago, when someone (presumably not Online, given his level of trust here on Sythe) recovered it. Now it is up to Online to help me try to get it back, and that's what we are presently waiting on.

Gotcha, thanks. Sorry for getting confused earlier. Please let me know when you have an update!

So, after a couple days, Online seems to be unable to recover the account, or has otherwise given up on trying. I'm seeking a partial refund, compensating for him for the time since the trade and the losses he suffered at the time for his currency exchange.

Online is currently refusing that refund.

I hate having to do this, but per rule #5 in the section rules here and this screenshot you posted above I'm afraid you don't have a case here because you agreed that Online is not liable for this account being recovered. It would still be the honest thing to do for him to help you get it back or partially refund you, but I can't DNT him for this.

After further discussion, we're sticking with the original ruling on this one. The buyer and seller agreed to terms of sale that do not protect the buyer from account recoveries (beyond the mandatory one month mark). For anyone else reading this, PLEASE be aware that ALMOST ALL accounts are recovered eventually. You can read more about this here: Changes and clarifications to the account market

I've also applied a TWC to @Online for selling an account without disclosing that they're not the original owner.
