User TOS never trump sythe rules

Suggestion to allow user TOS to trump Sythe rules which is subsequently shut down by FireZ - Allow User TOS to Override Sythe Rules in the account market

Another case - Scammed $50 + 16M OSRS GOLD

Another case - Scammed by Golden Mecca

One by n4n0 - Cut off voidonly in middle of skilling.

Another one - millenium dispute 200$ deposit refund request

I could keep going

 

In all of the above cases the TOS violated Sythes rules.

You cannot state "U agree to let me sell u this account then recover it and u may not report me for anything" because that is a VIOLATION of the Sythe rule "Scamming".

All the other reports share the above in some form.

Rswaps TOS did not violate any rules thus there is no past case where a non-rule violating TOS was not used as the set of rules/terms to rule on a specific case, thus making the report fully invalid.

If the TOS violates Sythe rules -> The Sythe rules dictate the report and the TOS is tossed as the ruling body.

If the TOS is within Sythe rules-> The TOS is the dictating body

Simple really, that's how companys protect themselves.

Valid TOS = That's the rules the report plays by.

Invalid TOS = The report plays by Sythe rules.

Sythe rules do not trump the TOS, The TOS does not trump Sythe rules, they have a relationship.

If the TOS violates the rules, the Rules take over, if the TOS abides by the rules, the TOS IS the rules for each individual case.

That is how it has ALWAYS been.

I have quite the track record, 14 total bans but ~10 reversed/overturned by my logic later, the 1 was pardoned for and was for an ancient offence and the other three were all temporary.

Vs probably what? 100+ cases won successfully?

99% win rate if u consider temp bans vs perm bans a win.

Considering I read every single report I feel confident I could get a different result on at least 3/4 of all the major ones where high profile users lost.

I know for a fact I could of won that King Tijn gambling case - That was ripe for the picking and he blew it .
