2nd day i did 1 quest then after few hours is a ban
so its from ur side ......

first of all when i did the crafting + firemaking both i did hand made + then when i went 10hours when im back it was like banned i said wtf :... so it isnt my fault that it got banned + i did hand done and i never ignored him when u pmed me in skype ........

 

as u see i said brb 10 hours when im back it got banned so its not from me ..
+ who will bot crafting or firemking that is like 1hour each ...

I thought u only use the normal 07 client cos u don't trust nothing else? now u swapped over to osbuddy? so why cant u show proof of getting levels for me?

less then 10 days (since joining), 2 ppl claim to be scammed & 2 claim to now have banned accounts :')

 

did not read the bickering in the thread but i think the following:
-david is sketchy
-you ordered a service that he completed but he got you temp banned in the process
-can you please post proof of what kind of ban it is (botting?), just screenshot the ban screen in your account details page. then we can take further action

A TOS is not something you can use to get away with scams. If you lie to you customers about your service being hand trained when you're really just botting their accounts, you're responsible for any bans that were caused by you.

i think you should refund the value of the training because the service you provided was obviously not the service you performed. if the account had been banned permanently, you'd have to refund the value of the account, but since that didn't happen, i think refunding the value of the training is reasonable

also, fuck you for botting on people's accounts and advertising hand-trained services.

It is always the case that with these reports it is hard to demonstrate that the service provider botted on the account. Here though, we have not one, but two people accusing you of botting on their account when you offered services by hand. Both those people received bans for macroing. Both those bans occurred at around the same time. Both those bans occurred shortly after you provided the service. I think we all know what happened here - the only hand training that went on here was starting the bot.

IMO you should be permanently banned for that - at a minimum TwC'd.

As for what compensation should be awarded, I'd say you need to refund all the monies paid to you for the service, because but for the assurance of hand-training, they arguably would not have used your services. Furthermore, like @Superfluous said, you didn't provide the service performed. I also agree with @Superfluous over the account valuations, and would only add that although technically a blackmark against ones offence history is something that could be compensated, it is probably to difficult to value objectively.

As to the ToS issue, you represented that the services were done by hand. This was an essential part of the agreement. You cannot exclude liability via your ToS for a breach of this essential term.

Just to add an extra opinion here.

 

While the botting is not easily proven by the individuals part, there is no incentive for Zufal to make a report claiming you got his account banned after training and due to the other report against you in the same time, I'm inclined to believe Zufal.

I would say perm banned or maintain your DNT until what you were paid is paid back in-full. After that, a TWC.

 

Please refund @Zufall the full amount with proof of photo and you will be unbanned with a TWC which you will be able to remove displaying good enough behaviour.

Failure to refund in a short space of time will mean you will have to request a full pardon.
