Arrested

Most college applications do ask if you have ever committed a crime/felony/whatever. However, you are allowed to upload a document explaining it and the surrounding events.

Since you admit it it was a crime they might go easier on you. They like people who make there lives easier.

Mate, fine + who you think their gonna beleive lol. Me and freind took fire crackers and lit em off in a park, 6000$ fine bro.

Thats probably because firecrackers are illegal in whatever state you live in...

By the way Durial... if you go to court argue that nothing of public property was harmed and you SHOULD be fine :)

Their not though, i was charged for Arson Attempnt, Disturbing public order, Public Damage, Disturbing Peace and possesion of dangerous weapons. Even though i bought them in a Variety Store for 5$. Very screwed.

Fine + Comm Service MAX. Sorry to hear duri. That's gay.

Well they did read us our rights etc.
But the technicallity is no damage was caused to the bench being iron and it was OUR property that was burned.

and looking at the california penal code

A person is guilty of unlawfully causing a fire when he recklessly sets fire to or burns or causes to be burned, any structure, forest land or property.

(a) Unlawfully causing a fire that causes great bodily injury is a felony punishable by imprisonment in the state prison for two, four or six years, or by imprisonment in the county jail for not more than one year, or by a fine, or by both such imprisonment and fine.

(b) Unlawfully causing a fire that causes an inhabited structure or inhabited property to burn is a felony punishable by imprisonment in the state prison for two, three or four years, or by imprisonment in the county jail for not more than one year, or by a fine, or by both such imprisonment and fine.

(c) Unlawfully causing a fire of a structure or forest land is a felony punishable by imprisonment in the state prison for 16 months, two or three years, or by imprisonment in the county jail for not more than six months, or by a fine, or by both such imprisonment and fine.

(d) Unlawfully causing a fire of property is a misdemeanor. For purposes of this paragraph, unlawfully causing a fire of property does not include one burning or causing to be burned his own personal property unless there is injury to another person or to another person's structure, forest land or property.

(e) In the case of any person convicted of violating this section while confined in a state prison, prison road camp, prison forestry camp, or other prison camp or prison farm, or while confined in a county jail while serving a term of imprisonment for a felony or misdemeanor conviction, any sentence imposed shall be consecutive to the sentence for which the person was then confined.

is arson and in section d it states if it is your own property and there was no structure or w.e. dmg then its not arson. May argue may just pay the fine etc. and shit. Dad got pissed but yea... first time I've ever seen the man truly disappointed.

u DEFINETLY will not go to jail. Me and my friends lit off a bottle rocket, and it hit a car, and someone called the cops, then the popo got us lol. The,we got fined about $450, nothin too much.

Eh, that's probably fun, but you're not hurting anyone directly.
>_> Should've done it more privately.

G'luck with it.

i don't think it will be that bad, stick to the truth, don't get mad, i've seen people get off clean without even a fine from something like this

Two friends of mine last year were throwing fireworks at cars, one of them just happened to be a police car and then they got caught, funny thing though they didn't have to go to court or anything, just got brought back home. They were both 15 when it happened.

I would point out that what you did isn't classified as arson, but don't get the judge pissed off :D

yea that was the thing but we didnt break the law in any way if it wasnt arson and I just don't wanna fail at proving that and get the judge pissed

It's not like you burnt down 9 churches or anything. *Cough* Ben Mosely *Cough*. I'd expect a fine and community service at most.

Just say that Section D of the arson code states that... and hope that the neighbor isn't there as a witness and says you were burning their plants or something :P

you most likely won't get any time, maybe a $100-$300 fine at max.

wow did you find that technicality all on your own, or did you have help?? good find imo, but yah i dont think they will be that hard on you

I know I won't get any time, but I'd rather not have this shit on my record or have to pay fines when technically I didn't fall under the law of Arson or anything.
I did have cigarettes and a lighter on me but I read laws up on those and it isn't illegal for possession of them only buying them for minors.
