    Couldn't find the right place so I guess this is a general discussion. I'm not trying to attack sythe, I love sythe, but I'm thinking about starting a forum for a different game and I was wondering if sythe is legal, like is there no risk in having a black market forum? It is against ToS after all... JW if they could get like sued or something :O

    As long as your sites not making money from trading runescape items or accounts, you can't be punished. Your not trading or selling the items its your users that are, so how can they sue you?

    agreed, but is buying and selling virual items on the internet legal? does a website need a license to buy and sell these things? does sythe have said license?

    Also, like what skele said jagex TOS has nothing to do with the law, only what they can do with your runescape account, and like what pen said, you don't need a license to sell something.

    Jagex can only punish you on their own grounds(affecting membership and whatnot). It's not illegal to break their ToS and is no way connect to the law. Skele is correct.

    As stated already, it's legal. This is why I believe that Sythe enforces it's rules (Especially about illegal things) very seriously...Especially the ones on scamming.

    The form of transaction occurring strictly on the site itself is just advertising. People get together to form private contracts of exchange. What they exchange is essentially of no one else's business.

    The law intrudes a lot into private contracts these-days, and in so far as it does, we ban people for trading in those certain things.

    There is a particular line of reasoning I think secures the legality of trading virtual goods regardless of the ToS of the virtual host. It is this:
    1. All virtual goods require time investment on the part of the player. And this time-investment makes up the vast majority of what gives the 'traded thing' value.
    2. There is no law preventing one player from hiring another player to play a game for him. This is also almost never against the rules of a game, but even if it is, there is no way to prove who physically played on a game account.
    3. There is no way to prove that a transaction does not involve the situation in point 2, as it is a private contract, and therefore the parties are not required to divulge its details to anyone.

    So one could reasonably claim that the entire site pertains to classifieds for personal services. (Certainly each seller will be claiming personal services income on their tax statements.) And trading personal services ain't illegal. It's like mowing someone's lawn, or fixing their computer, for a fee. Playing their game ~ not really that different.

    Okay, so let's say it is a classified ad. Lets say I make a site called umm... buyweed.com and people register and sell weed to each other. Isn't this illegal? Enabling people to do this? Just like how site owners can get in deep mud for having child porn on a site, even if they didn't upload it themselves.

    1. I agree with, but it is still against the ToS which IS rule. Could jagex put in the ToS that by breaking these rules you could be punished? (it might even already be there)

    2. It says that you should be the only one playing an account. Yeah they can't find out, but if you're buying an account you obviously didn't train it. We're not really discussing whether they will find out, but more so that when they do if you could be prosecuted.

    3. If its posted on the web it's already been 'divulged'

    So you're saying that even though it breaks the 'contract' that you agree to, it is still legal since it is a service? That's sort of contradictory is it not?

    I'm just curious if it could lead anyone into trouble, I'm not trying to get anyone into trouble :O

    The difference is that Child Pornography is illegal as is the sale of Marijuana ( In most countries). The buying and selling of Game accounts and Items violates no laws, only the TOS of the games which is NOT law.
