    Hi, my name is Raman and I am the Legal Counsel of Chicks Gold.

    I was asked by my client to respond to this post personally on behalf of Chicks Gold. It is attested hereby that the terms and conditions for Chicks Gold were drafted by me, and so were the terms and conditions for Digital Hub. In the interest of clarity, it is stated that [mod edit - real life name of client], the CEO of Integra Data and Analytic Solutions, is my client, and the terms and conditions for his platform Digital Hub were drafted by me. Thus this issue of plagiarism is not involved here.

    However, it is stated that the concept of “plagiarism” in the contracts/legal documents is not used as it is general literature (ref- https://uknowledge.uky.edu/cgi/viewcontent.cgi?article=1008&context=law_facpub_pop). i.e. one cannot copy the entire document and just change the names. However, if terms are tailored specifically to the client’s needs who are operating in different business segments, there is no intellectual property infringement. Apart from Digital Hub, one may find certain parts of the terms on various other websites, but as stated above, it shall not be treated as intellectual property infringement.

    Thank-you for the response.
    The legal definition of plagiarism is not what is being discussed regardless of what it is.
    If you're legal counsel then you should certainly brush up on your law:

    As a general rule, an employer will own the intellectual property created by its employees in the course of their employment

    As a lawyer I'd think you'd know that if you provided something to Digital Hub that you have no right to redistribute it elsewhere because what you gave to them belongs to them regardless of if it's employment or a contracting obligation.

    Now lets move on to the precedent that Sythe.org has set out.

    You have blatantly copied parts from a website for @Chicks terms and you have also included parts that have no relevance to the business of Chicks Gold.

    Examples:

    You don't act as a middle man. You're not PlayerAuctions or Eldorado so this is obviously copied and also false advertisement.

    I hope you at least understand what vicarious liability is because what you're producing for Chicks, errors and all, is his responsibility.

    If we speak legal here. Other users have been found guilty on this website for much less and this at least warrants a 1 month ban.

    There is no employer-employee relationship between me and my clients; whenever the clients hire me, there is a confidential contractual agreement between us which decides how the Confidentiality and IP shall be handled.

    You have locus standi to point out to me what I have included in the product which I developed for my Client. My job is to minimize my clients' liability for potential legal threats for services currently being provided or provided in the future.

    Any definition or term in the legal document cannot be considered an advertisement.

    The relationship pertaining to my work is between my client and me and shouldn’t be any third party’s concern.



    If the website (sythe.org) has any specific rules in place, it's their right to have so. However, I would like to bring this to the notice of Admin that the legal standing of the plagiarism for legal documents is different, as explained in my previous message along with the reference. This specific case doesn’t fall under plagiarism as both of the parties are my clients, and if anyone has any right to object, it shall be an exclusive right of my client(s) only and not any third party(not to mention clients have already signed the waiver). Furthermore, most of the T&C’s are framed on the basis of concepts collected form here and there, but the end product is unique and tailored to the Client’s specific needs. For example, Eldorado has copied PlayerAuctionsT&C’s, and even Facebook has 41% plagiarism report because many companies have used terms mentioned in the Facebook T&C’s. Moreover, there is no way one can stop someone from copying the work produced by another once it's published on the Internet. I have drafted hundreds of T&C’s and other legal documents by now, and if someone copies and creates their own unique work (T&C’s) to suit their specific needs, I cannot be blamed for such action and nor I have any right of objection until and unless they have blatantly copied the “entire” T&C’s “as it is” and just changed the name. Having said that, if Admin needs any further response from my side may indicate the same.

    So yes, the Terms of Service belongs to Digital Hub, not @Chicks

    You should also understand that Terms of Service actually does fall under Copyright law and taking that is an infraction.

    This explains it nicely.

    The legal arena has its own standards for plagiarism, and trying to get someone banned over something as inconsequential as similarities in two sets of ToS (created by the same legal representative, mind you) is inane.
