Closing down shop

Ok so it was quite an interesting chat with the objection commission. They were really understanding about the situation despite it being such a complicated situation for outsiders. All they do is give advice to the 'court' though, as they are independent. The woman who represented the court was quite interesting. She kept pointing towards the stack of papers she had with her and no matter what the commission asked here she kept saying "Based on the evidence we've been presented with our POV is set in stone". According to her I had like 16 accounts I've been handling donations with (which were in fact my RS mules to avoid bans) and she said that I was busy 24-hours a week with those donations for which I could've charged for, when I've chosen not to. According to her my second request for the insurance was also not yet accepted, but still pending, while we've been literally presented with the options to A) quit all online trading activities and get the insurance or B) the opposite. We've chosen for A and for as far we can recall our second request was accepted. If our second request is truely denied we most likely will sue them in an actual law court. Though we're not getting ahead of ourselves, right now we've got about 3 weeks till the objection commission gives their advice and 6 weeks till the 'court' here will make their decision, which is most likely not in my favor since no matter what the commission advices, they can still do whatever they please with my request.

 

The downsides of the insurance is showing up already: you must take note of how many days you reside abroad as there's a max to how many days you may reside in another country. Fun fact: My parents live in another country though I can get there within a hour by car.

 

It appears that the commission of objections has given the advice to the court here to uphold their decision, because they seem to agree with the court that it's hard to determine whether or not I was in my rights; if all provided information is correct and according to them it's hard to verify. What's confusing to me though is that the court themselves also send me post about them extending the decision they have to make about the objection. To me it seems like the court here is absolutely done with my case, so now that the comission has agreed with them I'm not so sure why they would be willing to take some more time about denying me, but who knows they can still surprise me. Next week I'll be discussing with another institute what the fuck we're going to do with this shit for now.

 

The discussion at that time didn't mean much, there wasn't much left to do while the court was still discussing what to do here. A week or so ago I've received some post from them and as expected my objection was denied. This new institute is working together with me on the objection now so this week I had a discussion with them what else is left to do here. We've called to the legal desk to ask them what else was possible to do here and asked if they could inform us about the success rate of starting a lawsuit about this. They couldn't tell us the success rate, though they did tell us we could contact some lawyers and have a free chat with them in order to have some more insight on this. We've agreed to do this and will be having a conversation next week with a lawyer to see what our options are. After all, this is about approx 4-5K in euros which I'm unable to receive since it's impossible for the court to determine how much I've earned while handling donations and such because of the price flunctuations in both Bitcoins and RSGP. Meanwhile the insurance I do have now (which was the second request) was still not put into motion, as I still hadn't received any money. This was resolved now though, after we've emailed them and heard there were issues with some of the payments.

 

Just had a chat today with a lawyer. The likely hood of us winning such a case is small according to him. For some reason the court gets screwed over quite a bit and basically they always assume the worst in people now. Based on what he said the court is basically not believing me that I haven't earned a dime while handling donations, neither that I lost money on it. The court seems most bothered about me withhelding information from them, even though I didn't think I should've informed them that I'm handling donations, since I didn't earn from it and I was basically middlemanning. The lawyer does think we can make a case as I said it's impossible to use the fees from donations as a way of monthly income instead of the insurance, so I have just calculated for him how much I would've earned from all the donations I've handled from June - October if I would've taken 10% off all donations. Basically still leaves 3k euros the court should pay me out, since I would've only made like 300 dollars out of that.

Just to update this matter; so far the lawyer is more informed in the matter and has written up the statement of defence which has been confirmed by me. I guess now we're just awaiting the court to review it and pick a date for the hearing.

 

Once again an update; tomorrow is the hearing about it. I'm quite nervous, but mainly because I'm expecting some kind of official hearing with black clothes, a hammer etc.

A result of the court is finally there and it isn't in my favor. In the summary written by the court they atleast said I've been completely honest in the process. As far as they can see I've delivered evidence of all I could. The city-court (defendant in this case) hasn't looked at all the evidence as necessary. Their assumption of me earning anything at all as a bondholder is wrong. The defendant in this case (the city-court) also assumed wrong on another payment sent to me.

To sum things up; in my country we have insurances (perhaps known as "alimony or welfare" in other countries) what you can apply for when you have low income till a certain point. In this case the town/commune/city you live in can grant you this insurance to make sure you get enough money to cover your actual insurances/home etc. The "court" is what I called this "town/commune/city". In the above I called it "city-court". The actual "court" (tribunal/law court) is where I filed objection to the -according to me- wrongful decision made in my first application for the insurance; it was denied because of lack of evidence aswell as because of not mentioning I was a bondholder on this website in the first application form.

My second insurance request was granted, but this means there's atleast a period of 3/4 months where I had no income, therefore missing out on about €3000/€4000 EUROs.

The above mentioned "objection" was denied at which point you can appeal it even further and file a lawsuit - which we did and the negative result of this has arrived today.

At this point I can appeal it once again, but I doubt it'll make much of a difference now. I've suffered from enough stress over this and I guess at this point it's just best to take my losses and move on.
