    Hello. So in the US, online gambling is basically illegal, unless you are in specific states. Also, it is illegal to operate a casino without a license. That being said, where does stake.com fall in this question?

    Is stake.com legal to own and operate in the US, but they are just not allowed to accept customers from the US ( PS: I know they arent based in the US, just hypothetical )?

    Is it legal for someone to start a online casino in the US if they are only dealing with cryptocurrencies?

    You cant gamble on stake in the USA or you didn't use to be able to.

    When you try to register it tells you that due to your USA location your unable to use the site.

    I understand that, but what about starting one of these casinos in the US, and just not accepting US customers. I’m born sure if this would be illegal

    In my opinion,

    It makes sense that you would not be allowed to run a casino website, from the USA, even not with US customers. If USA customers can't use it, why would USA owners be able to run it? That's just my opinion, I'm un-sure of the legality.

    I imagine the information wouldn't be to hard to google.

    Well actually it is kinda hard to find since some states are different. I have heard you can, but you need the proper license. I have heard you don’t because there is no “money” involved. I have heard different depending on the type of game and how the player gets chips or payouts.

    I will most likely consult a lawyer about this

    You can find some lawyer's which will usually give you a free chat on your topic your first time and actually really offer you some help! There should be so many factors. Federal law VS state law VS money VS cryptocurrency VS location, I would honestly go with the free lawyer phone call and post back how it goes.

    I am genuinely interested in how this turns out.

    Do you have a document of your state's law / federal law I could look at, what you're trying to go against?

    I work in a law enforcementish related field so my boss is a lawyer so I will try to contact him soon about this.

    After more research I found that stake.com obtained their license from Curacao. However I am trying to figure out the laws of operating in The US, but obtaining a license abroad. Curaçao makes you use domestic servers if you want to keep your license, which is understandable.

    A message from the owner of Stake.com; Stake.com is based out of Curacael with a Curacael gaming license. We base our support & marketing out of Europe & development out of Australia. All entities are essentially employed by the company in Curacael. Stake’s day to day operations are managed through Europe with shareholders based worldwide, with none residing in the US however.

    Does this imply that the gaming license is required? There is a site I will not post here that does not seem to have any form of license. Also, my question is ref. to poker, which isn't a house odds game. For example, in slots, the house owns the slot and you are playing against the casino or house. However, in poker, the house is only offering the table and the labor of the dealer (but with online, a user can be the dealer, so even then it depends on the casino) and the user is playing against other players. That being said, would a gaming license be required to offer online poker between users as long as I as a company am not processing payments, or in this case, converting money to chips and chips to money.

    I believe that is may be possible to offer an online poker table as long as users are using BTC bets only, wallets that are held by the user only, and no payment processing. If anyone here has any idea please let me know.

    Well Stake.com is owned by Australians in Brisbane, if anything does happen to them it will be tax evasion for the 30k+ per week they're getting. I know they're already getting snooped by feds everyone now and again.
