    What EVERY Sythe user should know

    I've been seeing a lot of threads where people get scammed out of big ticket items, such as partyhats or large sums of RSGP, and even real life cash. Some claim they will take the scammer to court etc. I'm going to explain to everyone here why you can't get your big ticket items back, even if it's real money. This is informative and it should make you more aware when you trade somebody here on Sythe. NOTE: These are contract laws for the United States of America, so some rules may not apply in other countries.

    In order to sue somebody for contract breach (ie. you paying someone money or RSGP and them not paying you back) there has to be 4 legally binding parts of a contract present.

    The first part is acceptance. This means that both parties must accept to the trade. However, you cannot force somebody into a contract, for instance if you came to somebodies house with a gun and then said "Buy my RSGP for $2/m." This part of the contract is usually completed on Sythe, so no worries here.

    The second part is competent parties. This is where some of the Sythe members can get off scotch free, because they are minors under the age of 18. In order to make a contract legal, both parties must be 18 or older, and both parties must not be under the influence of alcohol or any drugs. I've seen plenty of threads where some sellers go "Hold on lemme go smoke some weed real quick bro." and it makes me laugh. If they can prove they were high/drunk, then the contract is void.

    The third part is consideration. Both parties must be giving something up in order for a contract to be enforced. If Player 1 offers you a gift of $200, and then later on refuses to give it to you, you cannot take him to court because you were not giving anything up. This is why PayPal gift payments are also not advised.

    The fourth, and last part is the most important. LEGALITY. In order for a contract to be legally binding, it must be legal! You cannot pay somebody $10,000 to kill your teacher, and then sue them if they do not do it! If the initial act is illegal, then the contract is void. This means, then, that ANY Runescape gold/item trade is VOID in terms of a contract. Under JaGeX's policies, real world item trading is against the rules, and all items in game are property of JaGeX. This means that you are technically not trading your items, but JaGeX's, and they prohibit that, making the act itself illegal.

    Just thought you all should know this before trading any big ticket items, it's always good to be informed. Thanks for reading and I hope you learned something.

    Quite enjoyed reading this - i like the use of examples as well (we touch on maritime law on my course, don't understand half of it tbh).

    Does the Legality aspect also join in with the saying "in good faith" ?

    This is why Sythe needs specialized Arbitrators to solve these matters, that would be pretty badass :p (for a small fee of course)

    I'm glad you enjoyed it :) I don't think the concept of good faith applies here, as the act itself if considered illegal in all terms.

    That's why I make fun of people who trying to act BA and say they'll sue someone. The truth is there's nothing anyone can do except get himself or herself sued for harassment, lol.

    Very impressive thinking right there. This is some true logic points you have made. I really like what you said in the 4th part. That truly changes my perspective on trading. :)
    I always wondered why people would buy an airplane ticket and fly over thousands of miles away to a different city just to do the trade in person over a party hat or something lol.

    It completely depends on the situation. My cousin bought a car for $600 off of a sketchy lot when he was 16, and he totaled the car 2 weeks later. He got a lawyer and he got all of his $600 back because he was a minor at the time of the contract and therefor it was void. This is why if you try to buy a car or any other expensive item today and if you're under 18 they will make your parents cosign.

    I learnt this in law class and the "smoking weed somebody tried on me once" I realized it was a scam and then he raged lol, this laws somewhat similar to Canada's law but some countries have different laws and in some countries if you enter an agreement underage your guardian is liable.

    Isn't it possible to send them something physical, outlining them accepting the fact they paid so much for the random item you sent them? This way, physical goods are involved, so you have a case.

    I remember seeing that somewhere, to avoid paypal chargeback problems and further problems.
