The Situation: I worked for his Skilling and Questing team (UPS) for around a week a few months ago. I made the 15m initial deposit fee as well as the second 15m safety deposit (30m in total).

I got burnt out as a result of pulling some serious hours that week. I then decided to take a break and then eventually did not return. I recently spoke to them asking for my deposit back (never got it back from initially leaving) and GodGenesis refused to return my deposit (Do I need proof of him refusing to return the deposit?)

These logs show my initial payment of 15m and the later deposit of 15m that was deducted from orders worked.


















If there is anything else you might need please let me know. I wish I did not have to go to this level in receiving my deposit back, but was left with no other alternative.

 

Asked God for his input, but one of his workers got back to me sooner. Will wait for GG's response.

 

Just to respond to the quote. I was never actually kicked from UPS or at least informed of my removal. There was also no inactivity rule at the time of my employment to my knowledge.

I can confirm that StopSign did give his deposit of 15m 07 on 10th September 2014 and paid the remaining 15m 07 via orders on 17th September 2014.

Whilst the deposit is fully refundable when they leave, it is intended fully for those who are responsible enough to inform me or at least my executives for reasons of inactivity/leaving.

In this case, StopSign failed to fulfil that simple act of informing us before going AWOL. This has a significant impact on our manpower problem which at that time was a huge issue. And looking for crews in a short notice isn't exactly easy and such, orders were not completed on time and orders were being rejected.

We also have rules stating very clearly on our Terms of Service which can be accessed here

Under Section 11, I quote, "Being inactive in UPE is not tolerated. A crew member has a maximum of 5 days of inactivity without notification before being removed from UPE without return of safety deposit." As a crew of UPS, it is StopSign's duty to familiarize himself with this TOS which was shared a number of times in the chat group with StopSign in it.

Should he have any problems with it, he should have sounded out when this document was shared and we can resolve this issue internally.

I have explained it clearly to StopSign in my conversation with him on skype and the full logs can be seen below. It is clear that StopSign have been inactive from 18th September 2014 and only recently, 23rd March 2015, he attempted to contact me to join back UPS. Which shows he clearly knows that he have been kicked out of UPS due to his inactivity already.

Regardless of your Terms of Service, you may not withhold a deposit simply due to the user not showing up. That gold was theirs to begin with, so it cannot be considered compensation. If you had promised to pay them X amount of $ or GP, and then they didn't show up, that's a different story, since it is compensation.

My ruling is that you must return the deposit, and edit your Terms of Service to find a new incentive against going AWOL. My suggestion is to implement a lagging payment system which is partially based on showing up.
