Alright. My ticket was responded to. Good news.

I asked them if botting was not allowed or if it is alright as long as you don't request a refund.

    Their answer:

So everyone can stop freaking out and shit talking Photon and cancelling their subscriptions. Botting IS allowed.

If someone screwed me over like this I would take them to court. I don't care that it would be a loss in the long-run. I'd want justice.

They can't have Jagex do anything about it -- they act like, because you're cheating in a game, you're breaking some real-world law.

I'm surprised how mad this made me -- and I've been completely unaffected.

i have asked there live support the same thing many times is botting aloud it is plain and simple but to bot collect your gold and ask for a refund would be unacceptable in with any provider or even business related subject

compare it to staking if you rent a staking account maxed melle you are going to win big ok you lost 5m because you are the worst staker ever dont ask for a refund from the guy you rented it from its your own fault it was something wrong with your set up if it was working for everyone else

I don't get why people are complaining or scared of PhotonVPS all of a sudden. I am sure most people here have used this company for a couple months and have not had any problems, so you shouldn't have to worry about refunds anyways. I personally have not had any problems with PhotonVPS and it makes sense that the company will not refund anyone who has utilized their services.

They are trying to run a business and they don't intend to rip people off. You pay for services and you get them. If what you paid for isn't what you expected, you get a refund.

To put into perspective think of it this way. When you buy a new technology item and you decide that it wasn't what you expected you can request a refund within a timely matter and almost every company will honor it. However, if you already used your item for a couple weeks and try to get a refund, you will get slapped in the face. No offense but OP has already utilized their services and then attempted to get a refund... seems like he's trying to cheat PhotonVPS out of their money.

This doesn't make sense, and personally this is quite funny to read because I've been with Profuse Solutions for many years now and have NEVER heard of them not honoring their refunds (Reference: Web Hosting Talk).

Well, it says in the OP the vps didnt even work o_O so, of course he'd request a refund, they wouldn't even help him.

See I had thought that the OP was also trying to rip Photon off. But it looks like he couldn't even get the VPS to work, so I kind of see where he is coming from.

Now, I do agree that he should not get a refund because he has been using the VPS for 2 weeks already. However, Photon's customer support isn't the greatest and it takes them a while to answer tickets. I'm sure after days of waiting for an answer, you would also feel like you deserve a refund because of the terrible CS.

I am a Photon customer and I will continue to use them as they are amazing. This whole thread is a complete misunderstanding in my opinion. OP wanted a refund after 2 weeks, and they wouldn't give it to him because he had been using heavy resources for 2 weeks. Fair enough.

BUT, rather than threatening his PAYING customer with court, Jimmy should have sorted out the issue and acted professionally and simply explained why he wouldn't give the refund, instead of just saying "no."

But overall, Photon is a great company and I really recommend them.

I had a WARP 3 plan which is XEN. Secondly, I didn't even ask for a refund because it kept crashing. I asked for a refund because the password kept getting reset, and I was locked out of my own VPS for days at a time.

    Read above.

See, that is what I thought he'd say. The question is now, why did he tell me I violated the AUP when I only ran 3 RS bots? I was well within my resources to do so without causing any damage or lag to anyone else. That is what ticked me off the most, because he blatantly lied to me then in an attempt to justify him not refunding me.

I've been a member with them for about 2 weeks. I have 2 VPSs with them, the other one has been working flawlessly this entire time, hence why I only asked for a refund on this one. The fact isn't that I was botting 24/7 for the past 2 weeks and now randomly want a refund. It's the fact that it's crashed multiple times. They then told me there was no problem with it. After that, I get another random reply telling me the problem they told me was nonexistent in the first place, was fixed, so which is it? After that, I was locked out of my VPS because the password somehow got reset, and since their own reset feature doesn't work, it took 3 days just to get access back to it. THAT is why I want a refund, and I think anyone else in my position would want one as well.

Like I said, I'm probably a rare case, and maybe it just wasn't my day, I don't know. I guess I just don't appreciate the fact that he blatantly told me a lie saying I broke the AUP by running "intensive Java applications" when that consisted of 3 SG bots, all with the globals to the right. He also seems to deny that his company's own TOS explicitly states a customer can receive a full refund anytime within the first 30 days. I probably only botted on it for about a week, since the rest was spent wasting time with their horrid support team.

he was pry figuring since everyone else could get there vps to work and you where crashing your multiple times you where pushing the vps to the point it was crashing

somthing to look into should be how you where setting it up like i have noticed alot of times my bots will crash after a update i wont change the txt file to 472 or what ever or i am not running in safemode for one bot will lag the whole vps and crash but when all are in safemode all run with 0 lag

If you sue them, I don't think they could legally bring Jagex in, as they would have absolutely nothing to contribute to the case. True Photo could tip them off that you were breaking TOS of Jagex, but Jagex can't sideline in a courtroom saying that your breaking of Photon's TOS is somehow related to you breaking their TOS.

That guy is totally bullshitting you. Call him on it. Sue big ;)

    1. JaGeX most likely was contacted. Or vice versa. JaGeX knows that 100s of us use PhotonVPS for botting, so they most likely are pressuring PhotonVPS to give them information.

    2. If PhotonVPS did take you to court, they could sue you. You are doing something illegal with their servers which you paid for(yes), but they don't allow it.

    3. You agree to the ToS, you can't take them to court against their own ToS. Are you fucking dumb?

    Botting is not illegal.
There is nothing on the TOS that states you cannot use your VPS servers to bot.

ToS can be waived very easily, especially an online one if you get into a big enough lawsuit.
