Zune (graphics designer) Scammer or not?!

Explanation of the trade: I purchased a logo for 35$, under very specific terms, which were not fulfilled. Also very long waiting time with zero responses from the designer.

How they scammed: He promised to deliver a logo, whilst sending me samples along the way so that I could give the greenlight or request changes along the way...which he simply didn't do and instead threw at my face an end result, just like that...in a take it or leave it manner more or less.

Other relevant trade information: I am not saying it qualifies for certain as an "absolute" scam, (although for me it clearly is to be honest) neither do I even care about a "Refund"....however I do want a highly negative comment, post, penalty to be applied and STAY, on his profile and/or trading threads, which he can't just simply delete. Another important note is that even after a few days, I contacted again to request even those "minor changes" at least... still no response after 1 week, yet again.

 

Going to gather a couple opinions on this.

I've done graphics before and my ex was a professional designer, but I wouldn't need any experience to tell that:

1. That logo is shit, and not at all what was paid for
2. If you pay for a product, you don't get to deliver something and charge additional for time.
3. He doesn't like it. You keep working to get it right, or you refund him. The timeline thing isn't an issue, though I'd move further from the ocean personally.

Also, there's no way in fuck you spent 7 hours on that.

 

Gave my input on the Skype Chat, I too am siding with the buyer.

 

Alright, I'll let Dunworry close the report and tell you what's your choices, but here's what I think. Since Zune promised to give you samples during the process of creating the logo, and he did not do that.. there's 2 choices:

1. A refund

The refund I think is fair is 80% of what you paid him. Since he gave you a logo & still spent time on it, a full refund wouldn't be fair. You've seen his previous work & the quality he's offering, so you should've expected a little what you would get. However, at the same time, it's not acceptable to tell a customer that you will do something... and you don't do it. If Zune would've said no when you asked the question, there's a chance there would be another GFX artist doing the job. To compensate for the time he spent doing a sample of your logo, but at the same time, to penalise him for not doing what you asked.. I think you should get a 80% refund.

2. Create another logo or edit the current logo until you like it.

Now, I don't necessarily recommend that because if you don't like his work... this will never end & you'll be creating another report because of the logo that you don't like.... However, it is a possibility. Zune could edit the logo or create another one to satisfy you.

This decision will be discussed by both of you.

Next time, Zune, make sure to tell your customers what they should be expecting from you. If you would've made it clear that what you will send is the final product & there's no possibility to change it... then there wouldn't be a report right now. Also, in the GFX business, you need to learn to be patient and to give final products that your customers will like. I'm not saying to start-over 10 times... but I wouldn't recommend giving a final product, just like that, without the right to edit it.

Alright, so after a bit of discussion, here is what we came up with:

If you both are not able to come up with a compromise, then Vaizard is entitled to an 80% refund.

Alright, I will try messaging him one last time, both here and on skype... Although I am afraid, he will be unresponsive for a very long time once again (If he ever even responds back tbh). For the sake of giving him a chance to make amends. However, how long do you think I "should" wait for a reply, before a sanction applies.

 

If, after 7 days, he made no effort to get in contact with you & discuss about it.. then, tell us & he will be banned until he refunds you.

 

Agreeing with TheRSG0D here. He hasn't been online since the 26th, two days before he delivered the logo. I don't see any intent to scam, he did seem to make a meager attempt at rectifying it. I've also attempted to contact him on Skype/Sythe (If he does come onlien on Sythe or Skype before then, and doesn't attempt to refund you, he will then be banned).

I'll post back here on the 15th if you haven't yet for an update.

Ok so here is my update: It's now past 00:00 the 16th (at least for him since he is from the UK) and still no answer whatsoever, neither here nor on skype. proof: http://prntscr.com/afs68e . Now, in my opinion he was probably only looking for some quick buck and did a really poor job (yes, I definitely agree with Blade's statement that this design 100% didn't take 7 hours, not even close) not really caring wether I would be satisfied with the logo or not, the "Rectifying acts" were just some dust in the eyes as well probably and that's all there was to it. Of course that's just my opinion... the case is in your hands. Thank you for your time once again.
