A black transgender Minneapolis woman pleaded guilty to second degree manslaughter in the stabbing death of a local man, but her supporters maintain she was the actual victim in the case.

A group of people, composed of either all or just one a white supremacist harassed the transgender woman and she killed one of them with a pair of scissors. It was done in "self defense," but she's still the only one being held and that for second-degree murder.
^this pretty much sums up the incident, but there's more behind it, so please read the article.

Honestly, what are your thoughts on this one?

There is a huge difference between assault, which the self-defense defense can be used, and harassment which means no direct physical harm. You can't just kill someone because people were making fun of you, if that was the case then the kids who did Columbine would have got off incredibly easy(If they hadn't killed themselves). I didn't read the article, but I read your summary. Transgender or not, you can't kill someone over words - you can go to the police and have them arrested and some sort of legal injunction placed but not murder them.

Nero is definitely right, you can't just kill someone because of what they said, I personally believe imo if you feel like you're life is in danger then you can kill someone in "self-defense".

That^

Kinda off-topic but, in the UK laws are stupid, if someone was to break into your house and your caught them and they had a gun and you managed to beat them up, they can take you to court for beating them up...

Even if you were beaten to near death and managed to kill the person just before you'd die from another punch, they would probably imprison you for man slaughter.

I was thinking something similar to whatbyou guys said. But i saw someone (black) getting hotheaded over this so I thought that it would be best to trll my opinion after reaing yours

Qe have a similar law here; the victim is whoever got hurt the most. Self- defense means nothing :/

Definitely this charge is right as manslaughter. I mean yes some if not most of us will get pissed and retaliate when someone gets into your weak points but killing someone for something someone said is definitely not considered "self-defense" since it was a verbal attack and not physical.

Yeah that is the pretty scary part. There was this movie called "Felon" that I watched a few years back similar to something like this. They said that if the robber came into your house and you came out and attacked him, but he was outside and accidentally killed him you get trialed for manslaughter. If they did have a weapon they will rule it as self-defense but I don't know it's kinda of crazy to think that you can get imprisoned for trying to protect yourself and your loved ones. I know that if someone robbed your house and they have a weapon and you killed that person inside your house, then you won't get imprisoned. Not so sure if that applies today though as this was a few years ago.

It appears none of you fully investigated the article.

The individual who did the stabbing was treated for facial wounds when someone smashed a beer bottle into his/her face, resulting in 11 stitches.

According to various reports, McDonald — who was transitioning at the time — said she pulled out a pair of scissors in an attempt to defend herself after the group hurled a glass at her face, and taunted her and her friends with both anti-gay and racist epithets, including “faggots,” “niggers” and “chicks with d*cks.”

Edit: Not to mention the fact that this individual had no prior history of violence, compared to that of the white supremacist who already had previous violent encounters with others.

Shes both.

She was being harassed but killing another can never be a form of self defense when they were merely harassing.

She'll likely get a reduced sentence, but she shouldn't be pardoned.

Simply hilarious. In one state we have a law saying you can use lethal force when feeling threatened (stand your ground). In another state a woman is on trial for manslaughter because she stabbed an assailant. She had 11 stitches and was being harassed by a group of white supremacists. Do you guys really think that she was the agressor?

I think if the burglar is in your house, you're allowed to do whatever it takes to detain them or defend you. I believe it's if they attempt to run away, and you end up killing them - then you can get charged.

I could be wrong, but I'm thinking it's something like that.

They "threw" the glass at her face, not smashed her face holding it. There's nothing about continuous assaults in the article

Maybe this article is lacking further information but judging by what's there, bleh

The beer bottle was smashed into her face as a result of it being thrown by the assailant. Perhaps I should've worded that better, but I digress.

I watched the youtube video found at the start of the article in which it talks about the guy who died. He had a prior history of violence, unlike the women who did the stabbing.

A history of violence is irrelevant to the points of the case though. Unless it can be directly proven through witnesses that the bottle was meant for that person - and then if there was alcohol involved it gets turned into an entirely different case. The truth is that we are limited by the facts that we have and that these 'facts' can be easily manipulated by the media so we will never really know the truth of the entire situation.

I still stand by my original post though, if no physical harm is received on the part of the attacker or they did not provoke an attack then self-defense cannot be used.

Nero, THERE was physical harm done by the man who died he hit the transgender woman in the face with a beer bottle cutting her requiring 11 stiches apparently here eye swelled up a good deal too suggesting she was punched as well. They are also unclear on whether it was on guy or more people harrassing the "woman" if there were more than one person i would have to side even more so with the REAL victim, the transgender as the fear she would be feeling while being harassed by a group of people would help justify her actions. The guy who got killed allegedly has a swatstika tattoo and a history of violence and skinhead associations. By all accounts the transgender was NOT the aggressor honestly i dont see anything wrong with what she did. Another homophobic racist piece of trash in the ground, keep em coming. A beer bottle to the face could easily kill someone, someone using a weapon against you is the appropriate time to retaliate with deadly force. Im frankly STUNNED that anyone could side with that piece of white trash.

EDIT: To be clear i am a white guy, its not like im siding with anyone due to race.
