Your didactic little parable-ish story earns no sorrow from me. It is a crime to cause harm onto others, is it not? Smoking causes cancer and increased possibility of having a stroke, as does second hand smoking, so smoking around others could be depicted as committing a crime. Contradictory, i'd say.
Smog and engine exhaust is also a deadly carcinogen but I bet you drive a vehicle or ride a bus just the same. By using a motor vehicle that runs on any sort of petroleum product you are perpetuating the production of smog, and smog is a lot worse than 3 or 4 cigarette smokers standing on a sidewalk. Imagine thousands of smokers blowing smoke into the sky for hours and hour every day. You are, in essence, doing the exact same thing but on a larger scale.
