So to begin, I placed an order with CKB for the above service, on a hardcore ironman. He gladly accepted the payment and started searching for a worker. A few days later, he found a worker being:

Of which CKB took a 125m deposit for in order to work under his name.

The ToS, which were never agreed upon at the moment of ordering the service, were as follows. Please note it mentions nothing about the worker being negligent on the account during the order, his ToS clearly state he is not responsible under the circumstances that there is internet/electrical issues while on the account.

After the loss of status, as indicated I requested his worker to log off the account as it was of no use to me as a regular ironman. The worker complied and in the meantime, I waited for CKB to wake up and sent him various screenshots of the account at lumbridge with a regular ironman status. As shown below:

A little while on, I received messages from CKB apologising for the loss of status and he said he would figure out a solution to the problem. He offered to "rebuild the account" with "same stats etc" if his worker agreed:

In my eyes, this is him accepting the issue of the fact the worker "ruined the account" (which were his words) and that he would rebuild the account with the same stats the hardcore ironman had. However, his worker for this order quit before any details were sorted and received threatening real life messages as a result of this order.

As stated previously, the worker quit and therefore was no longer associated with CKB as a service provider, nor under his name. CKB then informed me that the worker would be happy to rebuild and finish the account but it would be privately and not associated with CKB's name. Now although the worker quit, CKB is still liable to fulfil the statements of him 'rebuilding the account' with the 'same stats etc'

To continue from this, after speaking to the worker, he admitted to be "cocky" on the account and at the time of death, he had no food in the inventory as he often ran 12-14 games on 8 cakes without banking but stayed in the game due to wintertodt being below 20%. This is not only reckless on such an account, but also negligent in the fact he knowingly chanced death on my account to avoid banking.

Further more, he also agreed to refunding me the 198750k for the service as well as 100m on top as compensation while rebuilding the account.

I repeatedly mentioned I didnt want it to be taken this far but it seems as if we unable to come to an agreement as he then later changed his tune after speaking to BlackBasses, offering only a 200m refund as well as a "HCIM account WT ready" with either "1-70 mining or 1-70 fishing" which really doesn't suffice considering he is now going back on his words and offering me a lot less in return for his worker's mistake.

After speaking to BlackBasses and after this event occurred, he changed his ToS to the following:

This proves his ToS were not only flawed, but also not covering the aspects he originally thought after quoting his ToS multiple times to me via PM as he felt the need to change them and add in 'anything else' in regards to the de-status section. Not only did he quote his ToS to me, he also claimed that it was unreasonable and that it could 'happen to anyone, me, yourself, another person'. The issue is that if I had died on the account, it would have been me that would have to take the hit for it, not anybody else. It's almost as if he is playing this off as being 'eh what happened, happened you would have lost status anyway' which, being a service provider, he is responsible for as the account was in possession of his worker when the death occurred.

To end this off, the reason I feel i've had to report this is due to not coming to an agreement on the refund price in a 24 hour period with ample time to negotiate and we are going around in circles making no real progress. CKB started off saying he will rebuild the account with the same stats, refund me the 200m order and 100m compensation. It has now been reduced simply to a WT ready account with either 1-70 fishing or 1-70 mining out of 'good will' and the 'kindness of his heart' and the payment for the service refunded as after his conversation with BlackBasses and whatever evidence he had sent, he claims he was covered by his ToS which certainly isn't the case. I believe he is stalling this out and trying to reduce the reimbursement due to him already admitting he doesn't have the funds to cover the cost, which is bad trading practices.

As well as the ToS being changed after this incident, terms of service with the clause: you automatically agree to the above by placing an order are not honoured on Sythe. These ToS need to be shown to the customer and they need to be agreed to before hand, which did not take place.

Based on this, you'll be held liable for the damages @CKB, I've placed a DNT and am giving you a final opportunity to establish reimbursement for @MS1909's loss of HCIM/incomplete service. If you're still unable to come to an agreement, staff will then decide on an amount.

 

I'm sorry for the short and unprofessional reply, i do not have much time atm, yesterday i was meant to be with my girlfriend for our anniversary but was not as i was on discord all day trying to resolve things.

i have been waiting from around 11am till now to recieve contact as arranged for at 1pm with him, i missed another reservation with my girlfriend

We originally agreed to a rebuilt account (which you stated would have the same stats) and arranged for 200m to be refunded at 1pm for the service as well as you offering 100m compensation on top. The account was then reduced to a wintertodt ready account with either 1-70 mining or 1-70 fishing, it was my choice which skill. Again, back tracking not sticking to your original offer. You then said you were only going to refund me 200m, without mention of the 100m compensation offered. This reduction came after you had spoken to @BlackBlasses about the situation at hand and claimed you were covered by your ToS to me via PM.

I did receive a message from you at 10am saying you wanted to go back to bed to which I replied you could as I was gathering evidence to post a dispute since we hadn't progressed anywhere. At 12.51pm i received another message from you saying 'Hey' so I am unsure if you were waiting around from 11am you wouldnt have attempted contact beforehand to say you were all sorted and ready to refund?

I would like what was offered to me and for you not to back track on your original offers.

 

I would like the account rebuilt to the same levels and bank it was before the death including the 200m refund for the service. I appreciate you mentioned you dont want to do anything that would risk the status, so if this is the case I'd like to request mods to talk to service providers and obtain a quote for a HCIM to be built to the same stats including supplies and bonds and that quoted value to be refunded also.
