Guilty or innocent?

Guilty. The mother's ignorance with regard to the vaccination is unbelievable.

Nobody answered me. If the other child has the vaccination, then how did she die?

I don't think she would be guilty for the death of the girl. More or less she would probably get trialed with some bogus "Accomplice" charge.

Ultimately, it was her choices that led to the childs death, but I guess we could compare that to me telling you to kill him. I didn't kill him, so I don't get a murder charge, but it was my choice that led to his death, so I'm still in the wrong.

In the wrong. Not guilty. -.-

Why wasn't the girl vaccinated?

EDIT:

Yes. There is a flaw in this.

The mother, by refusing to vaccinate her child, and then going out in public with him, is guilty as charged. By refusing to vaccinate her child, or quarantine him, she consented to committing murder indirectly. She was the instrument that instigated the girl's death, and therefore, she is guilty of murder.

I think the mother should be fined, although she should have warned people about her son.
I think she is a total dumbass, religion is such a pointless concept.

Seems like half this thread would want to be sued or prosecuted for spreading the flu, seeing as the flu causes more fatalities than measles + most other diseases combined.

When the girl contracted the disease, the first breach of her health, and therefore freedom, was made. This was a consequence of the mother's refusal to vaccinate the child. She is guilty.

You can deny medical care on grounds of conflict with religion. You don't even have to state what religion it is.

Therefore, she is not guilty.

If she has a vaccine, how did she contract it?

You can still contract a disease if you have been vaccinated for it.. For example, if your immune system has been weakened/compromised by another disease.

She was not vaccinated. /endstory

If she had a weakened immune system, she had a reasonable cause of death: "Being in a public place where one might contract diseases".

Then what would be the point of getting a vaccine? A vaccine stops you from getting the disease, or else more people would have small pox than they currently do right now, correct?

If the guys mother is put in jail, the girls parents should too for not vaccinating her.

Why should the mother be punished when the other child's parent was also too idiotic to get the deceased child vaccinated?

innocent, theres germs everywhere, if she got sick why dident she get vacinated? if she did not then her parents coudl get charged with murder if she gave it to someone else, thus starting a big chain of the same thing?
