Jesus, get the stick out of your ass. I told him not to refund me, then you came up with some plan on refunding me and he wouldn't have to do it something, I can't remember now. But I never required a refund, that was your idea after I got him to admit he was wrong.

 

You kept crying about being refunded, he then said well i'll refund half and you still weren't satisfied. He refunded you then full price you paid and then i said it was unfair and you knew it. I then told you i would refund moon out of my pocket since you didn't wanna see you were wrong too.

 

And would take about 3 months to reach a conclusion.

 

Then you think that it's okay to use copyrighted works in a banner you make for a client? Please tell me where that's okay. He also claimed he made it himself, when clearly, he didn't considering Kinae showed me the images.

 

In fact, moon should have been reprimanded for this if he wasn't already.

 

I had spoken to Richard and he decided it wasn't severe enough to ban him. It was still wrong though.

They're friends Mage, so he's just sticking up for Moon. But yeah, no one should use Def if he honestly doesn't see anything wrong with this.

 

It's not that i do that all the time, no one does. but simply using a stock of clouds. or anything you didnt make yourself is the same. I don't use copyrighted stuff and if i did i didn't know it was. If you expect someone to make graphics completely themselves and 100 percent legally, then please don't be retarded and order from sythe. Do you think that any of these people here bought licenses to the programs they use? Do you expect us to take pictures of flames when we need some in our signatures? Stop trying to be a smartass. I'm sticking up for everyone here in the graphics section, it's not like we copy paste someones work and sell it. not at all. Did you draw the render in your signature yourself? ya. ok. Kinaesthic isn't a god either. He uses stocks aswell. Go to a proffesional designing company if you don't want those problems. Back to reality please.

I wanted to stay away from this thread because I could see that tension is building up, but you guys left me no choice. First of all, Kin. I really expected more from you than to go behind my back and try to start a fight between me and Dial. Telling him that the stock I used was copyrighted was probably the most hypocritical thing possible. As for the whole copyrighted argument I agree with everything I have quoted from 75 Def's post. Just because he is my friend doesn't mean anything everything he is saying is factual and not to the slightest biased.

For those of you who remember, the precedent is clear regarding the ChineseKid ordeal.
The final verdict was that freely released copyrighted works are allowed to be used.

In addition, paid works such as things on GraphicsRiver or professional fonts are allowed on the condition they have actually been purchased.
That's all there is to it and arguing is pointless.

Donationware fonts are generally used on a DADT basis, there's no official guideline here.

In fact, Kina can personally attest to all of this, him being the one that started the entire CK thing based on nearly the same claim, back when he was GFX mod. I got the initial judgement reversed myself, though CK remains banned for a separate offense.

 

How the hell did this turn into a discussion of copyright infringement? Where the hell is Spray? Spray and I wrote out several stickies for the graphics section when he was re-modded - go ask him. One of the stickies was concerning the situation in which is being discussed here. Sythe graphics has lax rules concerning copyrighted work in graphics and Spray and I came to the conclusion that you can use any stock available so long as it is altered enough that it could no longer be recognized by a normal viewer as the original. It takes someone with an innate knowledge of graphics to pick apart a piece and find the copyrighted materials - hell if we went by strict copyright rules everyone who has ever posted a piece in the GFX section would be banned.

tl;dr: If the stock is incorporated in a greater piece (that is more than just slapped in there) then it isn't copyright infringement in the eyes of Sythe, or at least that is the way it was.

No one should use him if he thinks it's right to use copyrighted works in his designs that you pay for.

I never said no one should use him because he agreed with this thread. I said no one should use him because above he clearly states that he sees nothing wrong with Moon using copyrighted material in work, where he barely changed it.

I think it should be made that if you request something from an artist then you should have to pay them. If you don't like what they've done then you can request changes, until you like it (the artist could request extra payment if the buyer is being extremely picky)

If you go to an artist for work then you should check out their previous work before you ask them to make something, to see if their style is what you're looking for.

The current rules, someone could just go to an artist and completely waste hours of their time by saying you don't want it anymore once they've completed it.

i agree and disagree, on the artists part it would completely suck to put forth so much time and effort into a peice for someone and then have them say nope sorry dont want it anymore.

on the buyers end it would also suck to pay for something and then have it come to you looking like a jacked up peice of beef with your name scribble on it.

there is no real way to make this work. dont go to shitty gfx designers?
