BEGINNING today, every phone call you make, text message you send and email you write will be tracked by the government under a new metadata retention scheme.

Makes me wonder why I even use a phone, can't wait for encrypted messaging systems that allow for full privacy and not partway taken by governmental organizations.

Look up Edward Snowden. XKeyscore, PRISM. U.S. has been collecting your data for quite awhile now

Yeah the US has been collecting your data

This is the first time it's been legally required that Australian ISPs and telcos collect all our data.

They don't need a warrant to collect data from outside the United States, so they collect pretty much all of it, primarily from the middle east. Not exactly sure the amount they've been collecting from Australia, but I'm fairly certain they have been intercepting at least some.

Correct me if i'm wrong, as I'm writing a paper on this right now actually. Would help :P

Yes but they can only collect the data that passes through the United States. Australia has local servers for all major web services: Gmail, Google, Facebook, Youtube, etc. etc. In additional all our SMSes and phone calls pass through local networks. The U.S. has never had access to any of that to my knowledge. They would need to set up NSA data centers here to collect it.

But more generally: evidence collected by foreign entities is less likely to be available to and admissible in domestic matters. Whereas data collected domestically under local law will invariably be both available and admissible.

Consider that Australia has no bill of rights and we do not have protected free speech. If everything you say and do online can be linked to a bank account with this retention law then the internet, as far as Australians are concerned, is now moderated by the thought police.

I foresee this coming into play
The Racial Discrimination Act 1975 makes it unlawful to do an act reasonably likely to offend, insult, humiliate or intimidate another person or group if the act is done because of the race, colour or national or ethnic origin of the person or group.

"Legally" collect data that passes through the U.S. God knows what the NSA can do "legally" that's classified. Just considering what we've seen from Snowden + it has been years since Snowden.

Anyway, Australia is considered one of the five eyes, is closely partenered with the U.S., and I imagine the NSA is - at the very least - storing the meta data of all of the information you listed.

It's on private infrastructure. For example TPG and Vodafone would have to give them trunk access to make copies of all the data travelling through their pipes.

But even if this were already occurring which I strongly doubt (no one gives a shit about Australia to begin with) it doesn't make that data admissible. The data collected under the new law will be admissible and that's a big problem.

Not sure about the possibilities, but they started by saying they would not collect any data from U.S. citizens. Then they changed that they would only collect minimal data. then that changed to they're collecting everything they can, but that the vast majority of it was never looked at, due to them searching for "nonrandom patterns". The image below shows where they collected data from. More lines = more data collected.
