    Even tho, i felt harrased by any treats related to law suits of them, i do not feel alike making a counter-law suit against them.

    Why?
    Well, i kinda believe its a bad idea, to involve into it, when the law doesnt exists, into my country.

    As stated, I've heard that they either don't have much of a case or it would be a waste of time. A bluff on jagex's part.

    Discrimination is a VERY poor choice for a counter law-suit.
    You're breaking the games rules, if you're getting called out for being a botter, then you're going to most likely be a botter.
    Just sayin.

    Do you know the definition of a counter lawsuit bra? It means you are fighting back for damages caused from an initial lawsuit. You are basically asking them to sue you.

    If you sue them first, you need probable cause. To say they directly damaged you to the point that you need monetary compensation you will need to show that their threat caused legitimate fear. And why would it cause legitimate fear if you were not guilty? You would be on the hook for damages to the Jagex corp and court costs.

    You could probably argue that Jagex made the game so difficult and time consuming, that the only practical way of progressing through the game was to have a bot do all the time consuming and rather bland tasks. You could also argue that botting was promoted by other players within the game, and Jagex did not suppress the web ads immediately thus making more players vulnerable to turn to botting.

    If you botted a myriad of accounts for goldfarming, then you could be screwed and you should accept that you fail at life.

    But If I was taken to court I would just say fuck you and I win the case.

    The only real, and genuine counter sue you could use would be obtaining personal details without permission from the user or having a court order to do so.

    If they actually black mailed ibot/nexus to handing over personal details of ibot customers, that is a huge breach in data protection and Jagex could be liable to massive damage claims from the users, and could face having their right to trade through paypal and other online payment sites rebroked.

    Stupid thread imo. Botters are the ones who actually ruined the game, so now you want to sue them back for a small threat like this? Maybe Jagex had made a mistake sending those mails to "LEGIT" players but who knows that their records of suspicions of botters are correct/spot on.

    And i believe even legit players DO BOT unless you can provide me proof that you sit in your computer chair 24/7, no life-ing and training skills to 99 when it will take you like months or even years etc. Just my opinion.

    My understanding is that, when you agreed to create the account, you agreed to play by the rules, and if you didn't, you'd be punished in the form of your account being "stopped". Either that being a ban, a lock, or a mute. Those were the terms outlined in the contract between you and Jagex.

    Every time your account gets banned (say, for botting), the account still exists. The contract is by no means terminated - you've broken a rule and you've been punished. When you originally created the account, it should have stated that you must follow the rules, if you don't, you'll be punished. Well, thats exactly that. If in the T+C (terms and conditions) it didn't state "Oh, continuous rule-breaking will lead to you being sued", then you can't be sued. Period. You cannot add clauses to a contract once the contract has been agreed on. Otherwise it's null and void in law, and has no force of effect.

    Jagex can talk all the shit they want, they can't lawfully do this because you weren't aware of this at the time. You can argue that Jagex can terminate the contract when you bot, but they can't ban you for rule breaking one time, and then destroy the contract for rule breaking at a later date.

    Could be wrong, but it's just my two cents. Just looks like basic contract law..

    tl;dr: You and Jagex contracted when you made the account. Terms were outlined when you made the account. Suing wasn't disclosed to you at the time, Jagex can't add extra clauses to a contract without your consent - they can't sue you.

    This thread is ridiculous

    Jagex took Impsoft to court and got a subpoena against Paypal to release peoples details who bought their bots. This is totally legal and if you try to counter sue, I'm sorry but you will be laughed out of court. You will also further enrage Jagex who will most likely push for compensation to teach you a lesson.

    Seriously, stop posting about something you have no idea about (aimed at OP)...

    They are suing the defendants with the DMCA for copyright infringement. Their terms of service are not their main case.

    Oh right I see. In that case, "The Digital Millennium Copyright Act (DMCA) is a United States copyright law". So, this is only applicable to the united states?
