DNT Dispute

I am writing to dispute the DNT made against my account (elixr) on 22 April 2020.
Elixr's Services are a joke/scam.

The verdict of Fred's thread that accused my services of being a 'joke/scam' was: DNTed until this order is finished.

I started working with Fred in November 2019 and the issues with my services were raised in April 2020. The job in question was an animation for his gambling website, having previously carried out the website design. I was working on this project in February 2020 and by April 2020 90% of the work was complete.

Between February and April, Fred and I were in regular contact over the animation and the project was progressing well. However, Fred kept changing what he wanted from the animation and even refused to pay the remaining money and became threatening. This caused delays on my part but it should be highlighted that on more then one occasion I was waiting for Fred to reply to me.

In April I encountered some issues in my personal life which affected my health and thus I was unable to continue work. I wrote to Fred as soon as I was able, to explain the lack of communication on my part, we should also not forget that this period falls right in the middle of a global pandemic, so all services were slowed down across the globe.

Fred replied to my message with no empathy and no recourse or dedication to finishing the project. Although I am still not 100% in my health I have contacted Fred in an attempt to finish his project. He has not been forthcoming to take up this request and we are stuck in limbo.

Fred has requested a refund as he had to hire another designer, however 1) I state in my ToS that no refunds are offered in any circumstances and 2) I am aware of a dispute that Fred had raised with the second designer within the last month. It is therefore apparent that the work is still outstanding.

As I have attempted to finish the work for Fred in accordance with the verdict against me I see no reason why the DNT status should remain applied to my account. I should be grateful if this is removed immediately.

Given the amount of time it has taken for this to finally come around we're ruling that @elixr must refund @Fred.
