The Death Penalty: Legal or not?

    A. solitary confinement limits their opportunities to kill again.
    B. again, just because an eye for an eye is accepted by society does not make it legitimate. at one time apartheid was accepted by society. sure, racial segregation was common but you can not possibly argue that this would justify the existence of it.
    C. if you can not put a value on rape how can u possibly put a value on a life. you can not argue that a person with an iq of a 13 year old has the same value as a person who perhaps has a college education and contributes to society in a positive way. so in regards to this argument, life =/= life
    D. two individual cases are not very convincing buddy. there are many more cases you will never hear about of wrongly convicted ppl being sentenced to death.
    E. so are you jealous of their living arrangements? why not argue that point instead of stating ur disgust in how some prisoners are getting "better benefits than families with low income."
    F. so your argument in regards to revoking rights is "in for a penny in for a pound"?

The Death Penalty: Legal or not?

Why would you not add in something that is mandatory? Without the court proceedings initially there would be no death penalty.
Your argument that it is cheaper based on the fact that the act of the death penalty itself is cheaper is meaningless and stupid as you distort the variables.
Thats like that everywhere, you appeal to the court with higher jurisdiction until you reach the final court and get denied. In Australia's case it would be the High Court. The only other why is that you get a presidential pardon.
Highly doubt they get unlimited appeals.

So what would happen if he kills 10 people? Would he get sentenced to 10 death penalties? It's preposterous.
As I said before the only difference between the death penalty and murder is the fact that the act of killing is made legal in capital punishment. That is the only difference.

You should never ever kill anyone. If you do you face the consequences, life imprisonment with or without parole. Many people outside of prison can still kill others, does that mean we must sentence them to death? Besides there a rules safeguarding this, they are not flawless nothing is but if people are seen to be endangered in prison then they will be moved.
As for the loops holes lets talk about that individually.
If he has an IQ below 70 then he is mentally retarded and cannot be executed to begin with.
Murder implies intent, if the person can prove he did not intend to do it he cannot be charged with Murder. Right or Wrong this is how our judicial process works.
Diminished capacity is where in one doesn't have the legal aptitude to commit the act with intent. This is why he was jailed for manslaughter and not Murder.
    No system is ever perfect.
Both of your above cases the defendants the prosecution was unable to establish intent, and element to the crime murder. You cannot possibly tell me that the Death Penalty should be in place for manslaughter cases, you will not win. None of these cases were LWOP.

Both rights can be revoked. However honestly why should we use the death penalty over Life Without Parole? Life Without Parole means they will serve the rest of their natural lives in prison; period.
    [/QUOTE]
Whatever the case can anyone please refute this:

Murder is the unlawful premeditative killing of a human being.
The Death Penalty is the lawful premeditative killing of a human being.

The only difference is the law.
In a debate whether or not the Death Penalty should be legal or not, the argument that, "The Death Penalty should be legal because if is lawful", is absurd.

The Death Penalty: Legal or not?

I whole heartedly support the death penalty if the accused is guilty beyond all reasonable doubt. There is no reason that they should be left alive while their victims are either scarred for life or dead. Not to mention the enormous toll the life sentence takes on our government funds.

Most life sentences should be given the death penalty. Along with child molestors, rapists, murderers, etc.
    I would kill them myself.

The Death Penalty: Legal or not?

The death penalty takes up more government funds, definitely in America, and arguably for most other countries.

Why do you think such an act should be met with a punishment of death?

Also all the accused are supposed to be pronounced guilty beyond all reasonable doubt, yet there have been hundreds of exonerations, which means we simply cannot say that the process itself is anything but flawed.

Why isn't life without parole enough? They have been restrained to serve the rest of their natural lives in prison. Most rapists, child molesters get raped themselves in prison.

Do you think killing is right or wrong?
If you think it is right, then you cannot support the notion of illegality in murder to begin with.
If you think it is wrong, then you cannot support the notion of the death penalty.

I am in principle against the death penalty. There is always a possibility that an innocent is sentenced, and death is irreversible. Imo lifetime prison is worse.
If the matter will have a revenge motive in itself, it does not belong in a constitutional state.
The state should never be able to stand over the individual's right to live. Deprivation of liberty is always the worst punishment.

If a rapist rapes my child, and I avenge myself by doing the same with his children, is there an extenuating circumstance? Or should I be treated the same way. An eye for an eye makes the whole world blind.

When America can give you 1000 years in jail, they might as-well kill the person humanely. Even though, a punishment is a punishment, a prisoner should get to serve the years his crime committed him to.

Yes, if you kill another man you should receive the same to yourself. It's only fair. (Even though we don't live in a fair world.)

The Death Penalty: Legal or not?

In other words the act of killing to you is not morally wrong?
The only part that is morally wrong is the act of unlawful killing correct?

The Death Penalty: Legal or not?

I see no place in society for people willing to kill another human or people so careless that they pose a risk of killing people.

Exceptions: self defense in certain cases, and executioners for the criminals worthy of death penalty.

    Yes for death penalty.

Accidents come under 'Involuntary Manslaughter' and the prison time for this I think is under 8 years at the most.

The Death Penalty: Legal or not?

I read a short story once awhile back called "The Bet" and it deals with the death penalty as well. Not a long read and should be searched :D

I personally don't agree with the death penality. I feel it is an easy way out for those who commit crimes simply because it's all over for them after a few seconds - if any - of pain.

Also, if a person is wronly accused this at least gives them some time to possibly let the real killer be found. I'd rather sit in a jail for 10 years articulating my case and be able to be free than be faced with the death penalty and never be able to clear my name.

The Death Penalty: Legal or not?

Numerous cases of Lethal Injection have been known to last for hours, with the convicted screaming in agony for those hours.

The Lethal Injection itself is quite often administered by a CO, who has limited if any medical training.

Another fact is that it is your opinion that it's an easy way out, lots of people prefer life over death.

I see my irony. I just could not think of a way to word it I just wanted to say people that kill others don't deserve to live. You take someone's life yours should be taken. excluding my exceptions.

    Definately no support.
Whatever the criminal committed that death penalty is the only way (Murder etc), if criminals are just let to die, they don't suffer enough for the pain they did to be honest.

The Death Penalty: Legal or not?

    Misleading title xD

    Yes it is legal

No I don't support it. This is because I don't think we should have the power to kill someone and 'get away with it' even if it is at the direction of the state. Besides I think making someone live out their life in a 6x6 is much more cruel.

Yes but while their sitting in prison new evidence regarding their crime may surface. There have been many cases where people have walked free 5-10 years after being sentenced to life in prison in light of new evidence.
