    So this is basically for everyone to see so here goes(since staff already knows).

    Back in 2007 I had traded with vlad a lvl 30 something pure mage for god knows what. I recovered it a year later thinking he probably didn't use it anymore and was right, he hadn't logged in for a long time. Anyways, I posted it in the SL around 5 months ago while in New York and most people posted yet no response from Admins, so I don't know what they were doing.

    I had tried to to get in contact with vlad to repay him back and no response from him. So if you're reading this vlad PM me and I will repay you back the account or however much it was. (Note, I didn't have a paypal at the time so I never traded real money with him).

    So anyways, once Nate got banned for something as little as self vouching I made another thread in SL saying that I shouldn't get special treatment because it wasn't fair for me since I did something worse and I had no punishment for it.

    I mean that's basically it. You all know I put most of my time to clean up the site, read PM's, try and help users out.

    Anyways, yeah pardon or no pardon thanks for reading.

    Given the contentiousness of this particular case, I'm going to leave this open after offering my opinion, and, hopefully, Sythe will make the overall decision.

    I think Gohanforever is sincere and genuine; he also has a great will to see what is fair occur. He was not caught or prompted to tell the staff about this; he did so of his own accord. This demonstrates that he regretted the action. His regret also, I believe, shows character reform, a trait which has been consolidated by his personality - the extent to which he cares about other people, illustrated by his will to help and offer advice to others, his humbleness, and his kind inoffensiveness. The Upper staff also looked mildly upon his past offence - it was a long time ago and we were (unanimously, if I remember correctly) happy to pardon him. The issue only resurfaced when Gohanforever himself questioned whether or not he was receiving special treatment, which, perhaps, I believe he is. I think this forum does, duly, allow for special treatment, which I see as something positive, given the human capacity to reform and become better.

    I fully support a pardon and staff reinstation -- I think, should he be pardoned, keeping him demoted would be counter-productive and unnecessary.

    It's a tricky case.

    If a man buys a car from you, drives it down the highway then abandons it, how can you be sure he won't come back to pick it up?

    On the other hand if there is certainty that it will never be picked up, then there is no sense in letting it go to waste, and the property becomes unowned and may be homesteaded.

    I think, however, that in this case there is no way to be certain that the item traded won't be used later, so abandonment cannot be claimed. The transfer of title is therefore absolute at the point of sale. So there is as much wrong in recovering an account which was no longer yours as there would be in recovering an account which was never yours.

    Recovering property which you do not own is a loutish thing to do at the best of times, and theft at the worst of times. I think the case most closely resembles conversion (rather than theft). (http://en.wikipedia.org/wiki/Conversion_(law))

    Decision: Both the account and the value of the account should be repaid in full to the injured party whenever he/she can be found to render such restitution to. User is forbidden from seeking any staff role on sythe.org for a period of 2 months, after which time applications can be made (where applicable) as per the normal process.
