This is very childish, keep your comments to yourself and it is not childish in any shape of form he simply got banned from GFX section where he loves to spend his time so being banned there is like being banned all together.

 

What he did was use pre-made graphix in a signature without paying the full license, since he sold it, its against the law.

 

I pretty much agree with this, especially after reading his ban dispute, which I would definitely recommend people reading this check out here.

Did we ban people who uesd multiple clients to use many instances of one bot back when that was possible with rsbots? Nope.

I work at Envato and he has bought/downloaded from GraphicRiver and used this in his graphics (Which is against the rules of Envato).
He downloaded two of them (I assume as he did not gave me proof on the purchase) and used one of them with a license that can only be used for personal works and purposes.

Just to get this cleared out;
I did not want to get him banned due to competition, not at all as I appreciate fair and real competition.
I did get kindof frustrated because of it looked alot like he was copying what I do, which obviously is not a bannable offence at all.
Frustration comes with the competition, shit happens I say.
But when frustration comes with competition and I see alot of files in his works (That should not and are not allowed to be in there) it tickles me.
I have talked with two other moderators and a global moderator about this matter.

Hope things are cleared up a bit now.

After reading chinesekid's dispute, I'm also left asking the question why Kinaesthic - among other people who work in the graphics section - are allowed to use fonts with only a personal license, in work that they sell?

That is in fact also defying the copyright on the font.

To be honest, after Kinaesthic tried to get chinesekid banned for the signature that looked like Viou's it was obvious there was a personal feud between the two of them, chinesekid did produce a lot of his own work and banning him from the graphics section based on this incident is quite ridiculous.

It's hypocritical to ban him for this incident and not require every post in the graphics section to have proof of having the necessary copyrights to produce the work.

To be honest I really couldn't believe Clashfan allowed this without a follow up of some sorts considering most of the people in the graphics section would be banned from the section if this was the case.

 

Chinesekid was essentially "ripping" images from graphic rived. He wasn't ripping the whole image, but his smoke backgrounds were all from there. Now, that's okay if he'd paid for them, but he just stole them and resold them as pieces of his own work.

 

The lesson here kids is always read the ToS if you are going to do graphics. Make sure you know what you are selling before you sell it, though sometimes if you get packs from graphics forums they are very ambiguous.


Though altering an image declared as stock significantly enough as to not be recognized as the original then it isn't against the rules.

 

No what he did was take PS effects from the pack and resell them as part of his work while unmodified, which is against the ToS. I looked at the free effects and was really tempted to take them and use them, they were just that great.

Although that's how it may see, both him and Karl as well as those supported their statements have given clear reason as to why he was banned from the section of the market. Kin didn't do it to cut out competition, he did it because Chin did something against the law.

 

The point is, people are using fonts in much the same way - without a commercial license. It's ironic how the laws are being enforced.

 

wow i was planning to order graphics from you, but you seem to be a real dick. you seemed nice enough to me, but based on chinesekid's ban dispute, you use commercial fonts and other stock images that could be considered ripping from other sources

i actually feel really bad for chinesekid. you took away from him what he enjoyed doing, and that is why he requested a ban.

If you are going to be a bitch about this matter Kinaesthic, then have this go for everyone and not just the guy that you can't stand. If it goes for him, then this should go for everyone, and especially yourself. You're the one pointing out these "rules", then you must abide them yourself. You have been using images from the RS Wiki in just about all of your pieces of work. I have seen you state that this is allowed, but in fact it really isn't - images from Wikipedia aren't open source, and even if they were then I'm sure someone can go ask Jagex if you're allowed to use their material. They own full copyright on their images and you've been making lots of cash using them.

I smell abuse from miles away in this matter. Don't be a hypocrite.

And PS. Don't get me wrong guys, I do believe Kinaesthic's work is genious and he's only been using these "premade" images and fonts to give his GFX an extra touch, but it all comes down to the same thing. Banning Chinese from the GFX section is low, and seems to be very abusive, especially since you're not abiding the regulation you're pointing out yourself. If you happen to be reading this Chinese, I do not know you, but whatever has been happening here isn't fair and I do feel sorry for how you're getting an unbelievably strict case-to-case treatment.

 

I am hoping that this case is being worked on by the higher ups, because this is quite the outrage for me as a graphics artist here in this community.
