You could be having your own workers using the plugins. For all we know, we don’t even see your workers on the discord. We only see your “supports”.

 

You’d rather have the truth than a lie, hence why I am on those discords with my discord instead of an alternative discord. If I wanted to use plugins, would I really make it so obvious? All of the progression screenshots gave more than enough evidence to show that no 3rd party client is used. I’ve linked the transcript for the staff to see that there is not a single slight of “suspicion” for 3rd party client.

So you’re telling me, instead of using the plugins myself, I have workers that are using the plugins. And you don’t have direct-communication with them makes it even more suspicious?
Why on earth would I have workers using plugins that I own? Shit pull up 200 clients right away on my own pc.

 

Yet again, you can’t explain why there are two bans on the account during the time of the service. A perfectly clean account that you ruined. You only claim they’re false bans.

Perhaps you should go through what we've spoken about in this thread to find out your mistake.
Nobody can never ever explain a ban unless they know what they've done wrong. False bans are more than impossible to explain as to why. Hence why I mentioned by logging onto the account is ONE OF MANY reasons.

 

First ban was bot busting (temp)
Second ban was major macro (perm)

Jagex states the reason here and you’re saying this isn’t the reason?

 

If so, why did the temporarily ban get its appeal accepted. If they now mention it’s bot busting, shouldn’t it of been denied?

 

Because it was not done by me. It was done by you. Which is why you guys told me to appeal it through my home IP as shown below.

Then there's your answer for the perm ban. Because you appealed from home IP and got denied. I rest my case.

 

Don’t see why they would appeal it a second time with me using the same excuse. So tell me what would I be botting if all the exp gained throughout the duration is all agility. Clearly all the agility exp gained was from you/your worker.

 

You continued to bot/use plugins after the temp ban which resulted in a perm ban. You wanna know why I’m submitting a report in? It’s to spread awareness that you got my account permbanned. I wouldn’t want others to get temp/perm banned from using your service.

 

I fully respect it. I'm not against it at all. You know what they say tho; Innocent until proven guilty.

Facts

1. Edit: paragraph 9 of the ToS deals with bans. I missed that.
1. @JohnCeena hired @BoostedMMO to train agility from 91 to 99.
2. Account first had a temp ban. @JohnCeena appealed it and got it removed, didn't protest again @BoostedMMO continuing his work.
3. Account reached 97 agility and got permanently banned. Appealing it failed.
4. @BoostedMMO refunded the value of the unfinished work (97-99 agility) to @JohnCeena

The question is: can @BoostedMMO be held liable for the ban(s) on the account? In this situation, paragraph 9 of the ToS protects BoostedMMO from being liable. But even if this term did not protect him: based on previous rulings, the benchmark to hold a provider liable is if there is conclusive evidence that proves that the provider botted the account (see for example: here).

In this situation, merely circumstantial evidence has been presented that BoostedMMO botted the account. The accounts being banned while BoostedMMO worked on them is circumstantial evidence when taking into consideration that Jagex' detection system is known to be flawed. The appealing system is also pseudo-random. Therefore, these two points are circumstantial evidence. BoostedMMO being in plugin-servers is also (weak) circumstantial evidence.

Concluding, I cannot hold @BoostedMMO liable for the ban, because there is nothing conclusive that proves that he botted the accounts. @BoostedMMO paid back what he could not complete, so he is not in debt to you either.
