Bought an account and banned less than 48 hours later

Explanation of the trade: I bought a Mixed HCIM for 520m and less than 48 hours later it was banned for RWT GoldFarmer.
How they scammed: I understand ToS states @Wellness is not held liable for any bans after trade is completed, but I feel like this offense was not incurred by me as I did not gold farm on it.

I mean no disrespect to @Wellness as our trade was extremely smooth and he was very nice and respectful, as was I.

None of Wellness, nor my other accounts were banned. He suggests Jagex caught this as an IP change and assumed the account was sold. I have had multiple accounts go through my IP over the past year and none have been banned for any reason whatsoever, even similar accounts.

I understand I expect nothing out of this, but hope for some recoup on this purchase, if not at least serve as a warning that his IP/workers may be flagged for RWT/Gold Farm and serve as a preventative measure to future buyers.

I would just like to put some additional information for mods to read/respond to.

There was unfortunately a clear misunderstanding and contradiction between terms 2,3,7, and 10. 2/3/7 basically state the same thing, "not responsible" but I guess it was misleading to me after reading 10 that this responsibility ended after 3 months. I suggest that Wellness condense these 4 terms into one, simply stating he will cover all responsibility for the account UNLESS it is banned. Having it in 3 separate terms and then a 4th term lower on the list can be misleading to a buyer.

There is a large number of Iron/HCIM providers on that forum, that sell all different types of accounts. I chose Wellness because of the number of vouches and how well known he is in the community. I might understand this coming from a lesser known/trusted seller but for Wellness to be conducting a transaction for ~$270 and have the account banned(RWT/GoldfarmER) I feel this is unacceptable.

The ban clearly states the account was used by a gold farmER, not for gold farmING. Of which, I am neither. If the ban was macro or weeks/months afterwards, I could understand where I might not have any case whatsoever.

I feel like this is a blanket that Highly trusted users can sit behind/use to defend their products that is unfair/biased against buyers.

Lol, come on dude. We all participate in a community where buying/selling accounts isn't allowed. There was no misunderstanding between my TOS and what you understood. You're simply upset that the account was caught, and that's that. Just as if someone was selling gold and their customer was banned, it isn't the sellers responsibility, and not only that.. I clearly state this in the TOS. You read them and agreed to them, and if you were concerned you would of not followed through with the transaction.

You can try and spin this however you want, but you knew what you agreed to and you even stated that this morning:


This happens, and its unfortunate but trying to spin this off and have me be responsible is wrong and you should know that.

If anything, my TOS states it TWICE that I am not responsible. Unfortunately Jagex saw the IP change and banned the account, and just so you know and others know.. HCIM are way more prone to bans than any build because of the prestige with high scores.

Again, sorry about this happening but I've sold 350+ accounts and this has happened twice lifetime over years and years of sales.

According to you, this is a rare occurrence. I misunderstood terms at time of service. Regardless, I believe they are misleading, and you cannot tell me what I do or do not believe. I was under assumption that Term #10 would cover RWT bans(for an Ironman starter it is hard to RWT/Goldfarm) and that the 2/3/7 covered Marco bans.

I now assume this is why your ToS states so repetitively that you are not responsible for bans. In addition I have been much more respectful and went through the correct channels to attempt to recoup than the previous member was.

We will wait for Mod/Admin to decide, sorry to have this happen and involve you, I mean no disrespect.

It happens, especially when you deal in a BLACK MARKET community. You can spin this however you want, misunderstood or not, if you go buy a vehicle at a dealership and they have you agree to their TERMS that they won't refund your money once the car is off the lot, you can't return 2 days later and say you misunderstood their terms and expect them to assist you with a refund.

In other words, shit happens. Especially in a black market where Jagex is constantly trying to police account sales & RWT in general.

The fact you're even trying to recoup some sort of funds here when its clearly not happening is wrong imo.

Also, the other case was much different as he got a RWT ban literally minutes after the account was handed to him, not two days later.

Again, I state the fact that if this was a macroing ban, I could understand that there would be a hard-to-prove fact of who did macroing.
With this being a RWT ban, I would argue that you failed your obligiation to successfully deliver the account. The account was banned at 5:50am CST on 08/05/20, transaction was completed 6:30pm CST on 08/03/20. This is less than 36 hours after.

You are not to give a good shot at delivering an account I can play on and enjoy, it is an obligation per our deal.

I'm sorry you will no longer be replying.

I await a Mod/Admin to provide insight and judgement.

 

Talked to @video about this and we agree that @Wellness is not liable here. This is an unfortunate situation but not one he is at fault for.
