What's wrong here, is I am the original owner of the product but I simply gave it to Shop4MMO, I still have the link but the link has the file that I limited some of the things I had before I gave it to him.

I recently updated it because I had time and I needed thread portfolio so I added animation on it, I saw Shop4MMO was inactive so I renamed it DragonArena so he wouldn't steal it

 

So you sold him the gfx, and then he went on to resell it.

He still owns the rights to use or sell that product and you stole it from him (or in this case his buyer) unless you have a clause in your contract with him that he is not to resell or that you retain rights to keep it.

If I create a custom picture of a duck for @Bogla and give it in exchange for currency I no longer own that picture unless its expressly stated that I have rights to it or unless it was sold as a basic template that I am allowed to resell at whim

 

I just gave it to him to cos he wanted to edit. No we never came to the conclusion that he can not sell it because he said he just wanted it edited and he did that, I highly doubt he resold it if the thread is still under his title lol. My one is a different name but no one bought it I just made it for fun.
We never made a contract where i lost ownership, at the time, on my service I had TOS where i clearly stated I owned all files. I gave it to him because he never said hed sell it/ or take ownership afterwards. So i never coppied anything I wasn’t supposed to.

Reply: DesireX is apparently Shop4Mmo which makes me so confused because I gave it to some guy called Tiger on discord who told me to add a shop4mmo#8871 account. So obviously in this case, he never resold it. He just offered payed me so i could lend him the file to edit but I still own it, somewhere in our chat on discord I even asked if by doing this would i lose my rights... we never even concluded that I would and in my thread at the time, my tos had something like i own all files. its still like if I was selling the thread design normally except he offered some cash to have access to the psd.
I dont even know if DesireX knew how he got the thread design but I highly doubt the shop4mmo i talked to on discord was an outsourcing gfx artist so i never stole anything. The shop4mmo i spoke to matches the one on the thread, may have been desireX and forgot who I was a friend of desirex
I actually revamped the thread and was originally planning to give it to shop4mmo since i had it anyways. but the acc @Shop4mmo was last active on Feb so i thought id better change the name incase if he ever wondered why i made it and never gave it to him. I never even knew DesireX owned Shop4mmo
So i dont know what I plagiarised or stole if I still was the original creator and still owned it, ofc we never came to make a clause or a contract because it wasnt even sts and shop4mmo said it was just for some edits

 

No Shop4MMO never sold it, you are correct as far as I know.

Can you post proof of this terms of services and a Shop4MMO representative agreeing to it? I look through the edits on your GFX but failed to find a ToS.

Shop4MMO has multiple owners. "I even asked if by doing this would i lose my rights" can you provide chatlogs of before/after this message.

I assume he received it from his partner who seems to have been in contact with you.

"revamped" in that you stole ideas from some edits i made to that exact thread layout they requested of me. Here is the layout you originally made. Here is the edits I was requested to do. Here is the new thread layout in question. You have shown in the past you cannot keep from stealing ideas from other sythe users' work despite multiple reports and warnings.

By providing a client with creation files you automatically lose rights to the work, whether you are aware of that or not. Once you lost the rights to the work, you also lose rights to create derivative works (which is what occurred here). It is on the duty of the graphic designer to make sure both parties understand who owns the work and what the entails. If you haven't been doing so already, I suggest you make that very clear when working with future clients.

This dispute is denied and we will see you after the month has passed. If you have the screenshots I have asked for above you can send them to me on discord and I will take a look, as those could potentially invalidate most of what I said above depending on the contents of the conversation.
