The ultimate question is whether PA would have followed through on the bid, and, whether the intention of his bid was to artificially drive the price up. If PA was willing to discharge the debt by the amount of his bid, then he (a) would have followed through with the bid, and (b) there would be no artificial driving of the price up. The fact that PA is idolizes 'boy' is not particularly relevant if you accept the above. The 'shall i bid' is also probably just whether the PA's valuation of the account on a potential debt-discharge should be explicit or not.

Also in reply to the two recent posts, I've studied both those two statutes and those two sections specifically. They do not apply in this situation - s 52 of the TPA was repealed in favour of the now s 18 of the ACL (FYI) - technically it also only applies to corporations for constitutional reasons. As for the other one, I very much doubt you would demonstrate beyond a reasonable doubt that the dominant purpose was for PA and idolize to make a bid which benefits the seller; it is equally plausible that the bid was to formalise the value PA would give the account in the event of the account being used to discharge the debt between idolize and PA.

This is honestly getting a bit ridiculous now. We've gone from US Law to Australian Law. Sythe.org does not apply the statutes of different countries when resolving disputes (at best they serve as frameworks as to how certain scenarios have been analyzed). Sythe.org attempts to apply the common law where appropriate, and none of you have cited the common law.

Let me make this more simple. Can you show beyond a reasonable doubt that PA made a fake bid? I don't think you can because it is highly probable that PA's 'bid' was merely to formally represent the fact that he would value the account at X if he used the account to discharge the debt between PA and idolize. I accept the screenshots you've cited as less than good but it doesn't detract from the fact that you haven't satisfied your burden of proof. If you have anything new to add I'm happy to listen.

If you didn't bid over 925m, I would have taken the account for 925m. Do you not see the flaw in your logic? I did not deceive you in any way, you outbid me of your own volition.

Clearly in these chats that were taken after the trade i say to him that no one would have legitimately out bid me for the account.... that was after we had already talked about him having people fake bump up his thread.

@R0T So the 'ill see to it that you make money' looked to be in reference to something else based on the screenshot above.

Ultimately what you have is: you bidding say 800m. PA bidding 925m. You bidding 950m. PA says that is what he valued the account at in the event the account would be used to discharge the debt between him and Idolize. Thus, his bid was just a formality representing that fact. You argue that PA's bid was fake, as PA would have never valued the account like that, and only placed the bid to artificially increase the price.

Ultimately you bear the burden of proof. Now assuming PA was being honest, if they were confronted with your 800m bid, and he was willing to value the account above that 800m, the only way to resolve the problem would be to let you know - a bid. In this event, that is clearly not shill bidding. Assuming PA was being dishonest however, then they would have drove the price up to your limit. There is really little evidence to support both sides IMO. The 'shall i bid' comment could exist in both scenarios of PA being honest or dishonest. Ordinarily for shill bidding, you would expect multiple bids, yet here there was only one. PA didn't for example bid 960m, or didn't go 850m to your 800m, etc, or w/e the values were. Only one bid.

You can interpret the evidence both ways, but ultimately there doesn't seem to be enough evidence to support a fake bid (on the assumption Sythe.org disallows fake bidding). Since we start with the premise that people are innocent until proven guilty, that means we presume that PA was being an honest bidder, and so, there was no fake bid.

 

Please do me a huge favor go back through and read all the posts by me and scroll down through the imgur albums and re-read everything as if they were happening after the initial sale of the account. She reason i considered it shill bidding in the first place is that he had 2 friends bidding on the account to raise the price not just one=2 fake bids it doesnt matter who they were by and the pictures theres multiple malicious/shady/scammy things that are included..... ill post them again in snip bids to make it more easy to understand.

2. He had me "bump" his thread by telling me he's selling the account, which I decided to bid on on my own volition, clearly I state "shall I bid" and he didn't ask "can you bid for me".

3. Yeah I'm his connection, if he didn't know me he wouldn't have told me about the account and I wouldn't have bid because I wouldn't have seen the thread.

I agree 100% with malaka, im not seeing these fake bids as pureaddicitons bid was legit. Even if it was to discharge the debt it's still a legit bid.

Again, I don't care how much the account sold for, it was even in my best interest for it to be sold for less so I turn a bigger profit. I got paid the same amount by him regardless of how much the account went for. If I wanted to "shill bid you" I'd bid more than 950.. you literally raised the price by 25m and think "oh he backed off because of my mighty 25m?"

Are you actually that dense? He said he would've never let the account go for 600m, meaning he'd accept your bid and keep bumping the thread looking for more offers. My account has been for sale for 3 weeks, he had his thread open for 2 days. Eventually, somebody else would have come along and purchased the account.
