Why does that picture even matter, even if Colts 100% noticed it being sold and recognized the thread he wasn't taking into account that Racks was going to scam quit from it. For all Colts knew Racks was just going to try to turn profit off the account and then pay Colts what he still owed him for it. I'm not agreeing with how Colts went about it with the paying in increments agreement (retarded) but there's nothing malicious on his part. He shouldn't be expected to give away a max main with tons of hours put into it for free basically because of this

 

Doesn't explain why he lied and claimed he recovered the account as soon as he found out Racks was selling it.

I knew that Colts was aware Racks was re-selling it, and if this is the case then this is in turn consent for Racks to re-sell the account, he knew it was listed and for sale, there's no way around that.

 

I agree with this analysis. Logically speaking, Nemo means Racks has no good title to pass. Colts does have good title to pass however, and if he authorized Racks to sell, then arguably Colts passes his good title via the sale between Racks and Esky. This would leave Colts with no legal ownership, and only a debt as against Racks.

If this analysis was rejected, it means that Colts' authorization does not have any effect on the title passed, which would seem a strange conclusion (you would think it has some effect - perhaps a ground for contributory negligence).

As an aside, I also think the estoppel by negligence argument is made out; as soon as Colts found out about Racks' attempts to resale, there would be clear reasonably foreseeability of a possible event like this happening, and I think there would be sufficient salient features to justify a finding of a duty (in contrast to him just being a private seller entering into a simple hire-purchase arrangement).

Will revisit this when I get back from work tomorrow.

 

I'm also beginning to wonder, one possible way of finding out if racks on racks is esky is getting esky to privately show the email he should have received when he changed emails. Esky could be a friend of racks on racks or could be racks on racks himself and he just didn't send the info over to a new email because he didn't assume that would be checked, again this is on the extreme off chance it is racks on racks, if so that is one elaborate scam on his part

So once evidence is shown in a case that SHOULD help your case you decide to delete it. That's like a prosecutor showing a weapon used to kill someone and after a picture of it is taken they throw it away.
