They also told you it was a mistake and not a tip, so why not in that given moment did you not return it?

Bogla said he will be posting on it when he is online, so we will wait for him, I'm still heavily in favour of the 17m being kept or the 23m being returned with the payment refunded.

Also, just because someone makes a mistake, doesn't mean you use that mistake to your advantage and pocket their loss.

My opinion on the situation is that Mac actually does not owe Bogla anything, as he was given the CHOICE as to whether he wanted to pay back the excess 23m 07 or not.

If this is true then it makes 0 sense as to why Bogla should be able to keep the 17m as a "debt" that is owed by Mac, because there is no debt.

Eva gave Mac the choice as to whether he wanted to pay back the excess gold, and by doing this, whether it was a gift or not is irrelevant given the fact that Eva said he could keep the gold if he wanted to.

If Eva had not offered for Mac to keep the gold then there would be no argument, but by offering for him to keep it, it is in theory "gifting it to him".





Example:

Jefe sells Chloe 20m 07, but accidentally pays her 25m through no fault of her own.

Jefe acknowledges his mistakes and gives Chloe the OPTION of whether she wants to pay back the excess 5m 07 or not.

Chloe declines the OFFER to pay it back and decides to keep the 5m 07 (an option which Jefe gave her)

1 month later, Chloe purchases 5m 07 from Jefe and Jefe keeps the gold claiming she owes him 5m 07 from the previous mistake, even though he gave her the option to not pay it back if she didn't want to.



It's not a fact of whether Mac is a "decent person" or not, it was Eva's mistake, and I'll further stress the point that SHE GAVE HIM THE OPTION OF WHETHER OR NOT HE WANTED TO PAY IT BACK, it's not like she asked for it back and he ran off.

From what I'm seeing, he was accidentally given 53m instead of 30m and made it clear that it was an error, but Eva had no control over the situation due to the gold already being given to the user. At a later date e made an order and Eva reclaimed some of the lost goods from the previous error.

I'm not involved financially as agents are responsible for their faults in such situations, but I backed Eva's actions seeing as the 53m being given was completely unintended, and to my knowledge the user was made clear that it was unintentional but opted not to return it.

 

So why is my funds now being held and this whole situation happening?

Eva said that she tried taking a chance to see if the guy would be nice enough to return it since usually in these situations the customer typically wouldn't return the goods given in error. The guy responded saying he owed 23m and said he would be back later.

 

As i said i was orignally going to give it back but decided against it because she said i could keep the gold.

From my phone, so I won't type much. You clearly said 23m IOU. Bola gave you the option: keep or return. You manifested your intention to return. Like how Bola cannot go back and say a gift is not a gift, you cannot go back and say an IOU is not an IOU. I haven't read much above

You didn't need to say you would return it, it was made very clear to you that it was a mistake.
It should be refunded or payment kept.

 

As a consumer i was not obligated to return it i was going to originally but decided against it, im not the one running a company.

 

As Mala said, you cannot go back on an IOU.
So it has been decided, you are to return the 23m 07 to Bogla or they are allowed to keep your payment.

 

It doesnt matter, I was given a option to repay it, i chose not too, i was going to but had to leave for the night.
I am not the one thats suppose to be respectable and reputable owning and running a buisness
