    For the record "terms of service" are just terms of a contract. Unless both parties exchange something of value, then there is no contract. I would not consider access to an account which is then revoked a few hours later to be something of value.

    There's multiple other issues to address such as what the true terms of the contract actually were and whether the harshness of the terms were adequately brought to the attention of the coparty. Shoelane parking, South Eastern Railway, etc.

    Not to mention if the account was not his to grant access to, then even if a 12 hour lease could be considered a peppercorn -- it's not his peppercorn.
