I've been given the okay to chargeback Fr4n (counter scamming)but I've never charged anybody back.

If anyone could help me through this process I have currently sent him two 35$ payments for dicing, his paypal is unverified and it was sent as a gift if that helps.

I believe there is not option if you sent it as a gift. That's the problem with sending payments as a gift, they cannot be disputed on paypal and they are harder to chargeback. You'll have to contact them and explain your circumstances, why you used the gifting option to pay for something, etc.

I think you have good odds of winning unauthorized I believe paypal are more likley to side with the sender since it was sent as a "Gift".

Call and say the seller from craigslist told you to send the payment as two separate transactions through paypal and he told you to use gift option when sending and you didn't understand why blah blah blah. but you never received your items.

    PP will side with you

    Thanks for the suggestions guys.

Theirs no danger to my account when I charge back somebody right? I have a decent chunk of money in there that I don't want to get locked on my account.

Also if I claim it was from Craigslist and he said to send as gift then paypal would probably ask for proof right?

You can't get it back if the money was sent through your paypal balance.

You can if you file under unauthorized transaction. I'm fairly certain they are bound to investigate and refund all charges up to a certain amount because PayPal Balances are held with FDIC-banks. (could be wrong but I've rarely heard of a user filing a dispute not winning unless they other side has tracking numbers, shipping receipts and signature confirmations.)

You account CAN be locked(limited) if you file too many claims, but usually you just have to verify your identity with a government ID or bank account to get it un-limited.

And they probably won't ask for proof. And if they do, say he posted his telephone number on the ad and the conversation happened over the phone, but he has sense taken the ad down so you can't take a picture of it.

You should be able to get your money back fairly easily. PayPal will say they are going to escalate the claim and "investigate" but they really will just forward it to an account manager who will reverse the transaction.

Feel free to PM me or add my on Skype for help

Uh.. No. Gifts are indisputable and you can't chargeback payments from your own paypal balance. It would have to come from another source. You can go ahead and call them up claiming the transaction was unauthorized. After the investigation is done and they find out it wasn't, your account may suffer from fraudulent claims.

Alright let me try to lay out all the facts so I can get a straight answer.

-it was sent as a gift
-the money was from my pp balance
-his account is unverified and mine is verified.
    - I am not at my home ip but paypal knows I'm using this ip at hotel because I've had to call them a couple times about using hotel ip

Is it worth charging back? If there is ANY risk of my account being negative because of this or getting locked I will not charge back.

You cannot file a paypal dispute against gifts. Since the money was used from his paypal balance, it's not possible to dispute this.

You can't make a dispute online but you can call in and they will manually open a dispute so you can dispute it.

Can you give any proof of this? It goes against their own terms of service. By eliminating fees, you also get rid of the chance of disputing those transactions (gifts).

If this was somehow possible, it would only be for unauthorized payments or to change the payment type. Either way it doesn't put op in a situation where he is in control because as explained he authorized the payment.

Interesting though. I may have to give paypal a call later to verify this.

YES YOU CAN. Feel free to call them about it. There are several people on this thread that have verified what I have said. IT IS ALWAYS possible to dispute a payment. You just have to call for it to process. Read up on FDIC rules and regulations.

Proof PayPal balances are subject to FDIC regulation: https://www.paypal.com/cgi-bin/webscr?cmd=p/pop/fdic_banks-outside

    https://www.fdic.gov/regulations/laws/rules/2000-2900.html

Regardless of the IP you can verify it is you due to your PP being verified. I will try to be as blunt in this post as possible.
#1 Read the thread. IT IS ALWAYS POSSIBLE to dispute payments. Ghast is incorrect and I know this as fact.
    #2. as for your points..
----------a Due to it being sent as a gift you will need to call during business hours to file a claim.
----------b ALL payments (from PP balance, CC/Debit Card, + Bank funded) can be disputed
----------c The fact that your account is verified and his is not helps your case
----------d They should have the hotel IP on record then. You can even confirm with them that you DID send the payment but you were scammed. PayPal's seller/buyer protection is actually pretty good.

#3 It IS worth it to dispute it to get your money back.

#4 Unless someone sent you PayPal money in the past and is now charging YOU back, you will not be put into the negative. The money was already deducted from your balance, PayPal will not deduct anymore money from your balance. They WILL freeze the money that you sent on his end until the dispute is over. You will still be able to freely use all the features of PayPal

#5 Your account will NEVER become locked or limited due to a valid dispute. An example of a valid dispute that you can easily argue for your case can be seen in one of my original OPs (copied below)

If you need help feel free to PM me or add me on skype and I can help walk you through the process of it all.
