Need more advice about my child support case

    Need more advice about my child support case

    So in case anyone who is reading this hasn't seen my previous posts about the current legal problems I'm dealing with, I'll backtrack through that before I ask the questions I need answers too at the moment.

    In 2010, my daughter was born. I never get to see my child and when I tried to take it to court to get shared custody, they wanted around 300 bucks in service fees and etc, that is NOT including the court cost itself. So, needless to say, I wasn't able to do it (I'm jobless).

    In late June I was arrested for a class D felony of non-support. I got out of jail sometime at the first of July, because I managed to get my bail lowered to $500 from $5,000.

    My lawyer has suggested a probation plea because he says its the only way to possibly avoid prison time (max sentence of 5 years in prison). The restrictions of the probation is no illegal drugs, no alcohol & I have to make the full child support payment each month. Violation of probation puts me in prison for the rest of the probation. Its a 5 year probation, so if I miss that first payment, instant 5 years in prison.

    I finally got hired at a job earlier this month, but it turned out to be a scam. I found out the business had been shut down so many times due to legal problems and then reopened using a new name that they don't even put their name on the sign anymore, just a picture of a black rhino. I found numerous forums, websites and etc online where former employees claimed to often not get paid at all, get arrested for soliciting without a license and many other problems while working for this company, needless to say, I didn't go back for training.

    I've applied many other places, but so far I haven't heard back from them. My mom's trying to talk to her plant manager at the factory she works at to get me a job, but hasn't talked him into it yet and may not be able too because they don't like each other.

    I never get to see my child, she's 3 years old, 4 in January, and according to her mom, calling another man dad. Kelly, the mom, has been demanding I give up my rights since the baby was born. At first I said no. Then when I saw the $210.00/month child support bill piling up into the thousands, I considered it. I never get to see my child, why should I have to pay so much? But my mom talked me out of it, said that I'd still have to pay the child support because Kelly's on welfare.

    Now onto current matters,

    I met with my public defender today. He suggested I go to job corps because there is NO jobs around here. For those of you that don't know, job corps is a government program. They take young adults in and put them through "job experience". This will help me find a job, because there are literally NO JOBS around here, according to my lawyer. But, this is not an option for me. The people who go to job corps live in a campus like setting and the nearest one to me is around 5 hours away. I take care of my grandparents, they raised me, I owe everything to them, I can't just abandon them and leave them to be put in a nursing home by the rest of my family. It just isn't going to happen.

    My defender also told me today that if I give up my rights, it terminates ANY obligation to my child. He didn't mention if I still have to pay the backed child support, but I assume I do. He also told me it requires a lawyer and to go through court. So I'll need money to do this as well.

    I have a plan to keep my ass out of prison for the probation period as well as pay off the backed child support.

    I turn 21 on Thursday (August 8th) and even though my mom makes to much money to get welfare, if I make it look like I'm paying her rent, I can get $200 a month in food stamps, which I can give to my mom and she can give child support $200 for me until I can find a job.

    This doesn't complete cut out the problem, as my public defender believes while on probation, my child support will go up from 210/month to 250 - 275/month. I'm hoping that if I terminate my rights, it won't go up as I'll only be paying on the backed and not the current as well. 210 would remain the current, while it would go up higher to work on paying off the backed.

    However, the only lawyer I know of around here that isn't a public defender (public defenders cannot help me terminate my rights), wanted $1,500 just to meet with him about my case, which is why I ended up with a public defender in the first place.

    My questions:

    How can I make it look like I'm paying my mom rent to get food stamps? Would it be as simple as her printing out a fake receipt for me giving her money?

    How can I pay a lawyer to help me terminate the rights to my child? I'm considering taking out a no-background-check loan and then eventually filing for bankruptcy. Would this work?

    I need these answers ASAP as my court date is August 22nd and I need to have all this shit ready and hopefully my rights terminated by then.

    I don't know how you could make it look like you're paying your mom rent without any income coming in. You said you look after your grand parents? Maybe have your mom make up invoices of her paying you 200 dollars a month for taking care of them. Then write up recipients for paying rent to her and that might be good enough proof that you're indeed paying rent.

    Also whose the dad on the birth certificate? If she didn't write you down as a the father you basically have to do nothing until a paternity test is taken which in this case one should be taken regardless. It sounds like you and this girl had a bad falling out and a terrible relationship, do you even know if this kid is yours?

    yes, i got court ordered to take a paternity test a month or so after the child was born. I was told by the same court that is prosecuting me now that I shouldn't be getting a child support bill before being taken to court for child support (which I never was) but at this point, the court isn't worried about that, they're more worried about putting felonies on my record so I'll have an even harder time finding a job >.>

    But I have no clue whose on the birth certificate
