Requesting Unban [2]

We posted the above appeal over 3 weeks ago only to receive the following reply yesterday:

Was our appeal even read? We are unable to clear all “debts and issues” at this time for the reasons we've explained above. We acknowledge wrong-doing and wish to make amends but private negotiations have proved unsuccessful.

We understand that BBB's relationship with Sythe over the past few months has been rocky but this kind of blatant disregard for the appeal process is outrageous. If not for us then for those who are owed compensation please assist us in resolving these issues.

Without your involvement in this case nobody wins – we cannot do this alone.

 

I'm sorry for the delay. I've posted in the staff area to offer a solution to this issue. Pending staff approval I'll have some responses and we'll move forward with my proposed process.

 

We as well as you all know this has gone on for too long and there's been some unfair treatment with some being banned, and others not so much while leaving us to weave through the mess that this has been.

I'm going to ask that all parties involved please post their ONE and final story (not pages long) and a list of what should in their opinion be a $ amount that is fair for restitution in SIMPLE terms with basic reasoning.

If parties choose to not cooperate we're fine with having you all banned until you can work this out on your own terms. In this case we're simply going to act as arbitrators and give you a $ amount to repay that we choose is fair.

Frankly I'm not interested in middlemanning this dispute as it is miles deep, but we're going to break this down and do it the simple way or no way. If you all can't negotiate we'll happily ban you until you choose to work together.

Who owes who money and why:

No money is owed to either party. A *former* associate of BBB did carry out ddos attacks against DragonDyce - this is undisputed. But it is the context in which these attacks that were carried out that have been overlooked. BBB had been experiencing weeks of ongoing attacks itself prior to launching any attacks of its own. While we cannot prove DD was responsible for these attacks we have good reason to believe they were: BBB was in direct competition with DD at the time and DD's former owner, KO, has been linked to countless unethical practices, including ddosing:

While this does not excuse our actions it does shed some light on the situation. We have never pursued compensation for the attacks we endured nor will we. It is understood that basic ddos protection is something assumed when running any successful website – while a nuisance; these kinds of attacks are not the reason a business fails or succeeds. Xeir0's attempt to blame the failure of his business on these long-forgotten attacks and scrounge up compensation simply because BBB happened to become successful is shameful.

We stand by our evaluation of damages in this case to be 0, if Xeir0 is able to demonstrate otherwise we lend an open ear.

 

My goal here is to try and get my point across, and provide evidence then receive the opinions of Mods/Admins on weither or not iZinc owes me a refund if he gets unbanned (im sure he won't pay me if it doesn't benefit him). I don't wish to make anyone spend an excessive amount of time on this, so please only read through this all if you're bored or really want to.

CAUTION: My grammer (<3) is awful, as you may soon see. I'm somewhat of a comedian, and enjoy making people laugh. Please know that I'm 100% serious about this post, and do not want to bore anyone.

a few weeks I paid him another 500M as that was the price for a rank up to have a bigger max pot and receive a 4% rate on cash ins (from the original 3%). During the next week I was given a temp derank and a warning due to yelling at a flaming customer. A week later from that I received a 50M BBB chip bonus and my rank back, for showing dedication in the business and staying on for excessive hours without sleeping, during dead business times (little to no profit). Within a few weeks after that I paid yet another 500M for a General Rank in the business. This increased my max to 500M Rs3, and my cash in rate to from 4% to 5%.

Now(Feb 2014) I'm a General rank who has paid in total 1.5B Rs3 gold and have been a host+bettor in the business for over a month. I was very dedicated to the business and showed it. I would defend the name of the business and anyone who trash talked it or made false claims of the owners or ranks. Around a week or so after becoming a general rank, i was confronted by someone ingame whilst doing a cash in. This person claimed i was doing player ran games of chance. I told them i was swapping gold, they made me aware that they knew i was a host in bigboibets and claimed they were looking at the chat on the site for bigboibets. They also told me they had contacted Runescape p Mod ''Skiller'' and were going to have me banned. At this point I started to panic. Within 3 minutes of this going on, P mod skiller showed up at the location i was in. He then started to say ''Rwting is a bannable offence multiple times in public chat in front of me and BBB customers. I told him i was just swapping gold, and he claimed I had nothing to worry about if what I said was true. He then started to repeat things I was saying on the BBB website. I told him to stop harassing me several times and got into it with him. Shortly after that, My account was banned by J Mod Weath for ''Player Run games of chance'' http://imgur.com/t8cpEbV.

Shortly after I received the ban, I also was given a full derank and no refund. I asked iZinc for an Explanation and he claimed I was giving off a bad impression of BBB by flaming P mod skiller and I was ''Being dumb'' http://i.imgur.com/wSwmxFb.png?

I tried to explain to iZinc that Skiller was assuming I was a rank of Bigboibets because I was trading customers (doing my job). I never once mentioned Bigboibets at all, nor did I ever say ingame that I was a trader or a host for the site or any affiliates. Zinc's reasoning so far for me being deranked without a refund is that I portrayed BBB as a ''black market'' and that a P mod assumed I was apart of the site and Me flaming skiller made Zinc and his site look bad.

Few facts: for skiller to have truly known i was a rank he would have had to break Jagex's Terms of service by logging into Bigboibets website (which forces you to create an account before being able to view anything) to fully prove that I was indeed a rank and was indeed trading those customers for chips.

This being said, I was under the impression that he was not in the chat on the site, and instead an enemy of Bigboibets or an angry customer/troll was feeding the info to skiller through PM ingame. So for Zinc to claim I was portraying the site a certain way, is simply an allegation/assumption/opinion he made as Skiller did not have physical proof, but only a guess based off actions he saw. In my opinion Zincs reason is not legitimate enough for his actions. I believe this should have happened ---> A pending investigation with a full story provided by what Joopii saw (as he was the one who reported my actions to Zinc via Half done screenshots), and my take on the situation. Then after him/Joopii discuss it with all the information provided, a final outcome for the situation would be sent to me via skype message. Zinc always talks about how he prides himself on being a Professional businessman, if that's true then shouldn't he have done this ^ or something similar instead of ignoring me or never getting back with me about it?

When i first paid for my rank, I was given a list of rules. In the list of rules states to maintain a professional outlook as everyone is a potential customer. Not doing this would give me 2 strikes. I was under the impression that this was a 3 strike deal (as most are). iZinc as the owner never once clarified that 2 strikes would earn me an instant derank, without a refund. He also never spent the time to actually discuss the situation with me without leaving early and claiming he was busy.

I have plenty more details and I've spent a very long time and hate to do this to the staff @ sythe because i know ya'll spend your free time to help people and work this type of stuff out. I truly appreciate it. Sorry if this isn't as neat as It could have been, i really did try my best. This being said here is the final claim I'd like to make for this post before anyone gives their opinion or final decision.

iZinc Owes me a full refund for 1.5B Rs3 gold, or cash compensation of the value for when i was deranked (.45/Mx1.5B)

I ask this because I was never given a legitimate reason for being Perm deranked without a refund. iZinc never had the full story of what happened, since he refused to listen to me explain it. He also had not been provided with any video or full logs of the entire chat during the event in which before and after I was banned, he only has partial chat logs. I have tried to contact iZinc at least 3 times since that incident and everytime he claims he is busy or simply ignores me/goes off topic. Proof of these claims are posted below.

I understand he may be a busy man, but it's approaching a year now and I see him trying to come back with unresolved issues. I believe that's the same reason as to why my recent pardon was denied. I seek justice and fairness.

I truly cared about BBB, If anything iZinc has claimed is true on his posts, then he will man up about this and spend the time to settle it instead of blow me off or change the topic on his first reply. If he wants to return to sythe to massively grow his business then I hope he means every word he says when he claims that he will do things to make it right. The least i want is a fair trial.



Extra info about my motives as a rank, and after.
Being a host was not the best profit, so for those who may think I was showing ''false dedication'' or did things just for the money by staying up that's not true. I did drop parties and trivias often to make things fun for the customers by using my own money. Nothing was refunded or funded by Zinc or joopii for the events i hosted. I never had a payment plan where Zinc agreed to pay me 50M everytime I stayed up for 16-20 hours because nobody was on to host. He also only ever gave me a bonus for it once, and I didn't ask for it. The amount of money Zinc made from this is insane, he can easily afford to refund me. Not to mention I all in'd my profits i ever made on a 5B pot and lost vs him. I didn't do it for profit (a cashout would've taken 3-4 days). I did it to sever the ties I had with him, as I felt betrayed. I knew he had the odds.

 

My hands are clean, you have posted no proof against me.

A fucking 11 page document of various scams/blackhat activities. Even if you say KO has a bad rep, which he does, that doesn't make you innocent of blackhat attacks for months against a half dozen other businesses and not paying the 30% owner of your business his share.

So far, OP has absolutely no evidence against me of any kind but makes me out to be an aggressor, and I have absolute evidence of continued blackhat attacks against my server&business as well as many others. This dispute is just a blatant ignorance of stickies.

 

From what I'm seeing, these are the two posts relevant to what staff have asked for, correct? (Directed towards other staff)

 

In regards to this can you give me a dollar value as to what we're thinking here so I have it on record?

 

Has anyone heard anything from BBB on this? It's been a few weeks.
