    Why do we have fundamental rights? Should we?

    You do know what it is to guarantee a right in the affirmative right? Because the Bill of Rights doesn't do that for any right. It, as I previously described, gives limits to what can't be done to these rights (the rights can't be abridged). Therefore the rights are implicit and not affirmative. For rights to be affirmative it has to be explicitly stated, such as "Everyone has the right to tap dance on Tuesdays" or something like that and not like "Those people who wish to tap dance on Tuesdays cannot be abridged by a religious test". It doesn't say that you explicitly have the right but it implies that a right exists to tap dance on Tuesdays by linguistically stating that a right cannot be blocked or infringed upon by the stated limits.
