"Viral_" Sold unusable product, states no refunds, misleads, and almost blackmails.

Explanation of the trade: Purchased Vswitcher, vswitcher crashes my video drivers making the program usable.
Amount scammed: $50
How they scammed:
Sold me an unusable program. Program cannot work for me, Product crashes my GPU's graphics drivers, refuses refund because "Reason is not good enough" (Title part 1)

Also told me he will attempt to fix the issue, ONLY if I agree to only receiving half the money back if he cannot fix the issue. (Title Part 3, nearly blackmails with my money as the threat)

He also acted like he was going to give me a refund, asking me to confirm my information, for the sole purpose of getting a screenshot to prove I am the one who bought the product in case I dispute with stripe + my credit card company. (Title part 2)

I have tried to help him and he accepted it but never went forward with the help. I was being nice and making a deal per say that I will refund him half the money even though I have a no refund policy. This is most definitely not blackmail and the fact he is looking at it like that is ridiculous.

 

1, 2, 3. Your terms of service can say anything you wish. You can type in it "If I feel like stealing your money I can" and that does not matter. You sold through Sythe. You sold a product on Sythe that does not work.

4 + 5. You only offered your help IF I agree to only receiving half the refund back if you cannot fix the issue. An alternate word that could be used is extortion than black mail. Sorry about that.

The overall fact of the matter is, you only agreed to help if I only get back half the money for a product that does not work. Anyone on this website can put No refunds in their terms of service. If I purchased a product, I and every reasonable person expects a working product for the time purchased. The fact is, the product is not a working product, and in order for me to receive support, I must agree beforehand that if you cannot fix the issue, I will lose 25.00 USD for nothing.


Market Moderators, at this point this user has shown his character and I do not wish to continue any business or running programs operated by him on my computer. I wish for a full refund please. You can see in the chat images I was more than willing to receive help, if I get my full refund if he cannot help me. He has shown that money means more to him than customers.

 

I rest my case. I will leave it to the staff to decide. I stand by my terms of service.

I will be here when you decide to move forward with me helping you instead of you feeling like you lost your money.

 

I'd like to also include this user has a past on this website of being manipulative and threatening people. See his previous report here where he received a TWC for his actions. He seemed remorseful about his actions and got it removed, now he has repeated manipulative actions along with extortion.

Your ToS would only hold up if the user was provided with a working product. You can not use your ToS to hold people's money if the product does not work.

I have a no refund policy and my terms of service holds up for charge backs so what is the difference here?

There was no attempt to try and fix the "problem" that he has, and the logs on my website from him using the software say different. For all I know he is making it up because not one person has ever had that issue. He has logs showing that he has used the software.

 

Hi Viral. Your product does not work. For me. I purchased this product on Saturday night.

I contacted you Sunday less than 24 hours later with the issue. I actually contacted you moments after my discord friend request was accepted.

I accepted your help clearly in the pictures I posted at first. You then attempted to extort me by only offering support IF I agree to a 50% refund if you cannot fix the issue.


I contacted you within 24 hours of purchasing it yet I am trying to do what? Steal a day of free service? My logs show me opening the software for an hour. Attempting to use it without my graphics drivers failing.

Based on the picture looks like refund was completed. I will open another thread if I don't see the refund in 3-5 business days.

As explained above, you can't use your ToS to not issue refunds when a product doesn't work. You only agreed to help fix issues if @Whitey_Boy agreed to a partial refund, shown here: https://i.imgur.com/MGNwpM2.png. This is concerning to say the least as you were TWC'd just a month ago here: Threats.

I have reapplied this TWC as I don't feel your behaviour has changed. You were quite manipulative in offering only a partial refund and asking the user to agree to this before hand.
