How they scammed: we did 50/50 and after i gave him my 50% first, he gave me an account(which supposed had the money on it) but that account has been already banned.

From the screenshots provided in this report it doesn't look like Nemaya agreed to your trading method.
Unless I'm missing something, you'll need to refund Nemaya his OSRS gold.
