I think Rothbard argued against this in his book For a New Liberty (which you've obviously read), and instead argued for the system in place earlier in America's history, where the offender of a crime such as theft had to work for whoever he stole from until the amount was repaid in labor.

I'm not a utilitarian, firstly, although I do consider the ethical theory to be an interesting one. Regardless, I have a very Lockean view of morality. You are confusing the issues, however. This is not a question of morality.

This forum is run by Richard; it is his property. It is his right as a property owner to run it however he wants: if he wants to allow thieves to remain unbanned, fine, this is ethical; if he wants to ban people over the age of 25, fine, this is ethical. As the private property of Richard, it is ethical for him to run the forum in whatever way he wishes, provided that he is not impeding on the rights of others. The same applies to the whole Shredderbeam incident. If I know he scammed a few people, and/or helped a known thief, it isn't unethical for me to allow him to eat with me in my house; it isn't unethical for me to allow him to come to my dinner party; it isn't unethical for me to allow him to use my server to debate issues with others. Allowing Darren back is not a matter of ethics, it is a matter of what the most logical choice is.

If Richard denied this on the grounds that:
-Darren helped Sigex, and he absolutely doesn't want any friends of criminals on his forum, this makes sense.
-Darren lied to the other admins about this, and he doesn't want somebody who has lied to him on his forum, this makes sense.

If Richard approved this on the grounds that:
-Darren has made many contributions to the forum, and these contributions outweigh the damage, this makes sense.
-Darren would be restricted from using the market, and so could not use this forum to steal property from others, but would rather use it only to spread good ideas, this makes sense.

If you adopted one of the above arguments, I would respect it, and though I would disagree, I would understand the logic behind it. You didn't, however, you said that allowing him to come back would be unethical and claimed that I'm a utilitarian (lol), and I am NOT a utilitarian, and allowing Darren to come back is NOT unethical.
