Embedding videos illegal or legal?

Basically I had a discussion today with a friend over Skype and I've seen a lot of opinions on this. The reason why I'm asking is it might be a future project for me.

 

It's no longer copyright infringement. There was a court ruling and it was ruled in favor of Flava Works, Inc.

So basically you can embed videos but not upload them yourself as that would be illegal if you uploaded them correct?

 

Yes for copyright reasons. Unless you were given permission. Embedding a video just literally the same copy linked.

 

Very interesting, what is your source if you don't mind me asking? I myself haven't been able to find much information regarding this, a lot of mixed opinions on it as well.

 

Linking is not illegal, uploading and claiming it is your work is illegal.

Thanks, I read it, however it is from 2012 so some more recent statements would be great if there's any, could be the law hasnt changed since then.

 

I think embedding is legal but I would always place a reference along with the embedded video. Stating clearly the video is not yours and where the video is from. Better to be on the safe side.

 

I mean wouldn't that set a precedent for anything similar that might happen in the future?

 

Thanks for your input, I've tried reaching out to the big boys but none have taken their time to reply to me (which I figured) It seems that it's in a greyhat area between being legal/illegal, technically you're doing the same as Google, just linking to content.

Edit: Just paid for a lawyer to look into this issue, let's see what he says.
