My opinion? No. The law? Yes.

They might have a legal clause dedicated for special cases though, such as a self-taken consensual image. That said, I'm not educated enough in this area to say for sure.

Actually, anyone caught with nudes of anything are charged with child porn right away, no matter the circumstances.

There was an incident not to far from where i live that this 17 year old sent pictures to her 18 year old bf, and she got charged for child porn.

That's what a jury is for - to make informed decisions. If it sounds unreasonable, it's probable that at least one of the twelve jurors will see it that way too.

It is unreasonable. If anything, they shouldn't be grouped into the same place as rapist and child molesters. Thats just ridiculous.

Since when is being naked considered pornography?

What about all those roman statues you see in public buildings?

    Tj, an interesting read.

    http://www.wired.com/threatlevel/2009/03/aclu-sues-da-ov/

    http://yro.slashdot.org/article.pl?sid=09/03/31/215247

Edit: Just did some more research, no pubes, no boobs... and they're call it porn lol.

*facepalm* even more than the last one.

Pornography - creative activity (pictures or films etc.) of no literary or artistic value other than to stimulate sexual desire
Child Pornography - Anything above if the subject at hand is under 18.

Romain statues are entirely irrelevant. Artwork is NOT subject to child pornagraphy laws *ACLU case determined this. Stop making stupid assumptions.

You're definitely not old enough to say this. And if you are, you don't belong here.

    Lose lose comment.

16 is the legal age of PARENT concent, if you want to have sex and your parents dont say yes then its 18, so i would say if someone over 18 says yes and they send it to people over the age of 18 it should be legal, but other than that no. But i really dont care cause if your gonna let someoen take pics of you nude, dont cry when other people see them.

I think that if you can drive then your adult anough to send nude pictures to some one.
Then agin i really dont ever wana see a nude picture of a 16 year old. It whould be creepy if a 50 year old gets it and does stuff with it...

What he does in the privacy of his own home is up to him. As long as it is not causing physical harm to anyone, than why should you interfere?

What if you are in possession of a baby picture of someone you know that may show a penis or something? Is that child pornography?

The baby didn't give consent, so of course it is.

    Consent is the key here.

For real? There's got to be some level of judgment when it comes to this, I mean really what kind of person would arrest someone for having a picture like that?

There is a level of judgement, it is based off of consent.

Naked babies are not considered child pornography, unless you are somehow depicting sexual arousal.

That in itself is a wholly different issue.

I don't get why there should be a law. People's phones are private so I don't think there should be any laws regulating what goes through them. And the girl obviously was dumb enough to basically give her bf a chance to blackmail her if she ever broke up with him. Her fault for not thinking it through, and selfish of her to commit suicide. But the bf must feel like shit now lol.

Yes, There should be a fine or somesort, or even imprisionment for doing stuff like this. I too have been sent pictures of my friends x gf but I dont spread it around for reasons like this. Death is a serious thing, and this can easly lead to death. So yes i do think a fine or mostlikly imprisonment!

If you kill yourself over someone seeing your naked body, then obviously you shouldn't be living at all anyways.

I think it shouldn't be illegal, because this is the human way and we like to express ourselves this way.

And it's your ultimate decision to take a picture of yourself nude and send it to your lover anyways, so you should feel liable for the concequences.

This doesn't just have to do with this, but other things in life.. When you do things, you gotta realise what will happen... you know that the chances of your friend showing your pictures around are quite high. Even if you 2 don't break up, your friend will at least show your pictures to his/her close friends, right?

and I don't think this should be against the law because both sides know what's going on and are agreeing... when you take pictures of your little sister, that is probably not right since she didn't like it and felt uncomfortable, but if you two are dating and did it for each other, both parties are satisfied in the end. No loss. Well, until breakup of course.

However, I do think the guy should be held liable for harassment .
