he clearly didnt read the tos, and wanted to change it, accept my tos or i wont sell anything.

 

1st of all: You didn't give me a valid reason to trust you other than your TOS.
2nd of all: You made me say that I already received the upgrade.
3rd of all: You already have a complaint.

And btw, You can't make someone vouch after a sale.
