Edit: Not going to bother with copyright claims, many people have mentioned selling the eGuide itself is illegal on my part and travel/lawyer fees are worth more than what my loss of income would've been determined.

I will be releasing a free video guide of the lure hopefully by today or tomorrow.

No offence, but you are going to get no-where with any attempts at trying to seize money from him that he has acquired from leaking your "guide", and a lawyer would most likely laugh in your face.

Not trying to be mean, just blunt, you'd be wasting your own time and money. And its very hard to copyright information, it is not intellectual property in my mind, it is just knowledge of a virtual game, and we all know how low your chances are of winning a claim regarding virtual content in a lawsuit.

And even if you did succeed, you would what, maybe get $5 off him he's gotten in advertisement revenue? when your lawyer probably cost $1000.

P.S

How could you even prove your guide was your copyright... this thread just sounds like your mad because nobody is buying something that quite evidently is elsewhere on the internet for free.

I wouldn't look to seize money from his ad revenues, he would be paying for my losses in income.

He openly admits that his video is a product of a leaked guide, his audio matches my text word for word in a lot of areas.

The reason I made this thread was to understand more about copyright laws and if they could be applied to eGuides. Yes I am mad that somebody ruined my guide sales for their own personal profit. I think any person who created their own guide would be too.

Even if you were able to prove to an applaudable extent to a lawyer that he did indeed steal and redistribute your copyright for his own gain, you would stand no chance at suing him for "lost income" as the income is effectively illegal, off the books and is regarding virtual content, which is ridiculously hard for the current justice system to take seriously unless your some huge company suing for millions of dollars.

Its potentially comparable to a drug dealer, suing another drug dealer because he leaked his supplier, bought in bigger bulk and started selling the same weed cheaper than him, trying to claim lost wages.

You want him to pay for loss of income? Income which you don't pay taxes on? What are you trying to become the Al Capone of Runescape or something.

Don't you also have to register your guide for it to be copyrighted? Either way you would be admitting to Tax Evasion if you made over $400 dollars I think it is has to be added to your taxes so it can be claimed. But WTF do I know obviously billions of dollars are made on the internet that doesnt get claimed but people don't sue someone.

Personally I think you are like 14 thinking of suing someone over a Runescape guide. Better off throwing yourself into someones car and saying they hit you if you really are so hard up for cash.

Few other things is in your guide if you mentioned Runescape actually Jagex could sue you for profiting off of their property without permission. Again don't know for sure but basically its true.

But I agree any lawyer would just laugh you out of his office. Anything about court and a video game just get it out of your head you look like a dumbass thinking you will get rich of some other 10 year old because he stole your guide to a game. How could you prove that you didn't steal it from his video? You gonna march other 10 year old kids into court to say they traded Cownap on Sythe for a guide? How dumb is that. I feel sorry for you.

...........I really do.

Mr. Cownap do you swear to tell the truth the whole truth and nothing but the truth?

MOOOOOOOO

MOOOOOOOO

I don't have to pay taxes because I'm 17 and don't earn over 10,000 in a year. I don't think Jagex would have the motive to sue me.

The guy I'm dealing with is in college and didn't want to reach a settlement. Severity is irrelevant to me, I'm simply trying to see if copyright applies to eGuides. I'm a bit ignorant about copyright laws online and that is why I went to Sythe to see if anybody could help me out.

I did like the MOOOOOOO part, I'll give you that.

I see your point but I'm not sure if they would see my income as illegal though if taxes don't apply to me. I'm sure a small claims court would take it serious.

Even if taxes don't apply to you i still believe they would find your income illegal, they would probably claim your guide was infringing intellectual property of Jagex LTD, therefore making the case void as it would no longer be classified as your copyright, meaning the plaintiff (youtube leaker) not viable to compensate your loss in wages.

Secondly, i couldn't see a small claims court taking it seriously either, but perhaps it would make an amusingly pathetic episode of Judge Judy, at least that way even though you'd lose the case within 2 minutes i think you still get paid what you were suing for by the show for your participation.

Thirdly, i seriously refuse to believe you would even attempt to sue somebody, for leaking a guide on a virtual black market, over a video game. I'd recommend you to discover a new source of income, or perhaps create a new guide.

File a copyright claim on the youtube video. Youtube is pretty good about taking them down -- even if you submit fraudulent claims. You won't get money but you'll get his video removed and will put a 'strike' against his account.

I'm certain you're not going to 'talk to your lawyer' and sue him or anything... You're getting advise from ten-year-olds on a Runescape forum, for gosh's sake.

He took down the video immediately when I showed him I was the creator of the guide and owned the rights to it. I wasn't so much looking for advice when I created the thread but was more interested in copyright laws and how they can be applied to eGuides; which nobody knew about either.

it amazes me that someone would even think about talking to a lawyer about this

I was also motivated by how shitty his attitude was towards me, he threatened if I filed copyright that his partnership with TGN would sue me... and I kept good financial records; enough to prove a loss of income that was correlated to him publicly releasing the guide for his own profit.

Simply talking to a lawyer isn't a bad idea ever, a woman won a case against McDonalds because she spilled coffee on herself and it was very hot.

Overall after some research it would have been a loss in money due to travel/lawyer fees even though I had a valid case. However you probably aren't even reading this response because you seemed more interested in your post count than any input.

There's a ton of reason why you can't do anything but simply put there's no chance and even if it was possible the court and lawyer fee's would be more then the profit lost that you can't prove you lost.

The question is did you copywrite your guide also have you been paying tax on the sales of your guide if not you sir may be up for an even bigger fine

First off your guide is uncopyrightable as it is already breaking previously held intellectual properties. That means that any copyright claim would be void.

This is a frivolous law suit and a judge would laugh you out of the court room. Seeing as your are a minor meaning you cannot make any contracts as they are automatically void. Next you are infringing on Jagex's intellectual property meaning that you have no case. Even if taxes don't apply to you this income is made illegal because you are breaking the copyright laws before you even get the money. That would be like a big name torrenter trying to sue another torrenter because they stole their CoD torrent.

This is what my legal teacher was talking about. People like you are the reason our court system is so backed up, suing over completely retarded stuff. You cannot even measure your loss of income as it would all be an assumption, unless you had some kind of deal setup wit 60 people who were all going to buy the guide.

You had no case, no matter what you think. Your case has so many holes in it a lawyer would be incredibly stupid to take this case, because there would be no winning it.

It would be extremely difficult to prove it was your guide he stole, and seriously what lawyer is going to waste his time over a guide on the Internet over a game? You would be wasting your own money and time with this. My advice to you is to just pack up and move on, things like this happen to a lot of people in life and you just have to learn to live with it I'm afraid.

If you've been to the Runescape eGuide & eBook Sales section you might have seen "[RSGP/$USD]Cownap's Ice Plateau Luring Guide". I use to make a solid daily income from guide sales, I noticed however when I came back to Sythe to sell the guide more actively that nobody was buying it.

Eventually I found that the guide was leaked to YouTube. The guy who leaked it used it in a video which he often took excerpts from the guide. It was an obvious hit to my income and he is generating money from ad revenue from the video. If I am able to prove that his video is based on my guide which specifically said at the top "Don't leak this guide" is he in violation of any copyright or plagiarism laws.

He also openly admits his videos are all from guides which he leaked.

I'm trying to get some other opinions on this while I wait to speak to my lawyer. Anybody familiar with copyright/plagiarism laws? are eGuides an exception? is a patent needed?

you can't just say something and it fall under copywrite law you have to have it sent in. secondly this is runescape you won't get approved for something as trivial as this. but something you can do if he is a youtube partner you can turn him into youtube and get his account shut down as it vialates their partner ToS because I highly doubt jagex did not agree to allow him to use their game on his videos.

He took the guide and pretty much word for word turned my text into audio. He also openly admitted that he leaks guides to make his videos. However I decided that the only thing I can do is show Youtube and probably before they could review it he took the video down.

Thanks for the information but I don't like how you use me as an example of the problems with the legal system. I never went through with it, I was simply asking people online if copyright laws can be applied to my eGuide. I also don't like how everybody took such an aggressive tone towards a question, I'm ignorant when it comes to law but I never did anything wrong on my part.
