Selling Runescape Gold - Legal Implications

I know this has probably been discussed numerous times, but I am quite curious to know if it is legal in the US to sell Runescape gold.

The argument for it being illegal is that I agreed to the TOS and I would be selling Jagex's intellectual property, therefore, making it fraud.

The arguement for it being legal is this:

When you agree to the terms and conditions, you agree to the rules of the game, nothing more nothing less. The only punishment you can receive will be in-game punishment. Those terms and conditions do not apply to anywhere but www.runescape.com. You are selling your time invested into the account. And yes, you are breaking a Jagex rule, but that in no way involves Real Life laws, because the Terms and Conditions only apply to RuneScape itself.

Regardless of the answers I get on here, I will be sending a copy of Runescapes TOS to our family lawyer. I will post his thoughts on here.

Sending it to your lawyer? Why? Did you get in trouble with the law and Jagex or something?

 

Interesting situation. I guess it all depends on the technicalities of the TOS. Would like to know how this plays out though

 

Basically it's one huge loupol (not sure how to spell it). They can sew you if they find that you've cut their profit or some shit but they have yet to do so yet.

but anyway i have no idea, i highly doubt tho that they would even catch someone selling rsgold and as if they would be able to sue some like 15 yr old kid because he was selling rsgp, so im pretty sure they only put in the TOS to scare people not to actually act on it.

just like when they say we have new great anti botting ban system, when they dont lol just trying to scare people out of using it.

 

Yeah that's what I figure too, but my parents are going nuts on me saying I can't do it. We have a legal plan that gives free legal guidance, so may as well take advantage of it

 

How can it be legal? you own nothing of jagex's game, basically jagex made this game. they let you play it, your basically leasing a character. Jagex owns everything, just like how they can rol back your account and take all your wealth away if you get caught macroing. would this be considered "stealing" by jagex, if you all say its YOUR property to sell/trade

It's not 'Legal' as such because it is breaking the TOS that you said you would comply to when signing up to runescape. You won't actually get in trouble for it, at the most you will get a runescape ban.

 

It's not technically "illegal" but it isn't technically "legal" either.
All I know is you could face civil penalties if Jagex really wanted to pursue it, but criminally, you have nothing to worry about whatsoever.

Coming from a pre-law student.
Civil problems such as being sued could be a possibility, but I've never heard of it happening.

It is legal.
But.. you ARE selling Jagex property.
