    For over a month, I have been in a trade regarding a name transfer with the user: blazee

    These were the agreements to the trade:


    *Note the "it is your responsibility to transfer the name"
    *Name has been whited out, if mods need to know the name I can send the original screenshot

    And recently, as blazee attempted to transfer the name he sends me the message "The account has been locked" -- apparently meaning that Jagex themselves removed the name? He then suggested that I post here and await a mods ruling.

    Proof of recent conversation:


    *Note a pm is missing as I sent two and he responded to one. The other pm was "I got the password from the trade screenshot. I logged in to the account settings and the account is not locked?

    Did you get it unlocked?"
    *We decided to keep the same password so that the account wouldn't get locked



    So here we are. I am not really sure what is going on as I am unaware to hidden mechanics of name transferring. I don't know if it is possible for jagex to "remove a name," or if that is what happened in this situation.

    I know that blazee is a buddy to some of the mods here... but hopefully that won't affect your decision.

    Hey mate, thanks for making this thread so we can have an opinion from the staff. I'll provide my side of the story and we'll see what agreement they come to.

    A month ago I started talking to Themaulpure about purchasing a rare name. We agreed on some terms that are started in the above picture. 30 days later, I went to transfer the name per usual and the name was removed in the process. In the PM I send, I accidently said "locked" instead of "deleted", that was my bad. This has happened to me before and doesn't happen out of the blue moon. From what I understand, this is Jagex's way of combating name sales. They only watch fairly rare names that are being made ready to transfer, and stop them from being able to swap accounts. In the past few months I have transferred a few rare names, but nothing as rare as this. So as stated above, the name was not sniped, but removed instead.

    You can see in the image that I agree that it is my responsibility to transfer the name and he replies with the payment does not have to be sent until after the name transfer attempt. A few lines below I cover "leaking" of the name and advertising it to other people. This term was clearly broken as the "Friends Chat" channel name was "Selling Name" (http://puu.sh/1TpJS) <- I have given "video" proof of the name E Cryy being the new display name given to the rare name during the transfer. He should be able to confirm that but if not, I can always link another moderator the video of my confirming.
    This lead me to thinking Jagex removed the name because it was clearly advertised to be transferred and associated with RWT.

    Name deletions do happen, and you did name your friend chat "selling name", which makes yourself an easy target for Jagex to delete the name. Blazee's not my buddy but he did inform me of this several days ago. I told him that I'd have to hear your side of the story too. I'll also double-check with some experienced name sellers that name-deletion can happen

    The Friends Chat channel name has been that for the past year and a half. You were in control of the account and I was told not to log on. I don't really understand how that is "breaking the agreement," as the friends chat channel name has been that long before our agreement. I had no idea that the channel name was still that, but clearly you did. Why didn't you just change it when you got access to the account?

    It's just strange that you never mentioned this was a possibility before.

    If you were aware that the FC name has been like that for a year and a half, why wouldn't you change it before the name went ready for transfer, it's basically telling Jagex "Look, I'm in the middle of selling this name". I was in control of the account yes, but I was not able to lock on because there is a high chance that it would've been auto-locked.

    It is breaking the agreement because if someone was the join the rare name's FC during the transfer period, they would be directed to the new name (E Cry) which said "Selling Name". After seeing that, user's would've tried adding it to their ignore list to see what the rare name is, and attempt to snipe it.

    There is honestly nothing much else to say, I'd like to leave it to the mods to decide.

    It's been a few days since I last replied, so it's probably time for a post. Ultimately, we need to determine who's at fault or if blame is to be shared equally. I see evidence of risky behavior from themaulpure changing the fc name to something that might grab Jagex's attention, but I don't see anything to fault blazee for. It's unfortunate that Jagex deleted the name at all, but they did it for a reason and it looks like there was a pretty good one as provided in the evidence here.

    Would like some other eyes to take a look though

    Name deletions do happen. I wouldn't doubt for a second that the name got deleted because of your FC name. Jagex isn't ignorant. Yes blazee takes on responsibility for the name transfer but there is only so much he can do. There is no evidence to suggest that blazee was careless with this transaction (if you have some post it). The only careless actions here are by Themaulpure that I can see so I don't see why blazee should have to pay for his mistake.

    A bit about name deletions.. name deletions are very rare when selling on Sythe. Most name deletions occur when someone carelessly advertises it in game, which is why I think your friends chat is the cause of the deletion.

    This seems to be an unfortunate event. The terms involve a trade of 90USD for a 'name', whereby the payment will be rendered after the name transfer attempt.

    I'd just like to ask, what do you guys take 'attempt' to mean? Both blazee and themaulpure.

    Another part of this agreement involved keeping the name on the down-low. Themaul says that the name was in the channel for the past one and a half years, and Blazee contests that this would violate the terms of keeping the name on the down-low. Other than this supposed breach, Themaul has done everything to honour his end of the deal (if not, please correct me).

    As to this argument from Blazee, if the account was already in a situation where it would violate the agreement, then this agreement would be invalid from the beginning, and if you were to hold it legitimate, you could in principal transfer the name, and not pay him! You could interpret this as the contract being invalid from the beginning, ergo Blazee does not have to compensate Themaul; I don't think this is the way to go for one because both parties acted as if the agreement was in effect. Alternatively, you could view that there was a legitimate agreement, rendering Blazee's argument invalid; I'd go with this option.

    With that latter option, this would effectively mean that BOTH parties have honored the agreement to their best capacity. In my opinion, since this event, was more or less out of both parties control (we've already dismissed themauls alleged culpability by going with this option), it could probably be considered something akin to an 'Act of God' and the 'impossibility' defense would apply.

    BEFORE that however, I'd like to know one thing, and I'll circle back to it:

    What do you mean by 'name transfer attempt'?

    EDIT: This thread can be closed. It was an unfortunate event but nobodies fault in particular. I don't have time to pursue this further.
